Christian County Court Cases 05/30/2023

The following court cases was heard on May 30th, 2023:

 

Tavonn Adams: Defendant present in custody with counsel and State's Attorney present. PC found over the weekend by Judge Frisch and bond set at $15,000. SA McWard has conflict and will seek appointment of Special Prosecutor Defendant will post bond today. First appearance with counsel 6-13-23 at 10 a.m.

 

Kyle Adler: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury.By agreement, final pretrial hearing scheduled for 7-25-23 at 1:15 p.m. Jury trial scheduled for 8-7-23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard

Kevin Carrell: Defendant present with Public Defender and State's Attorney present. Case called for hearing on Defendant's application for recognizance bond or reduction. Arguments heard. Bond reduced to $20,000. Defendant admonished and consents to 402 conference which is set 6-19-23 at 8:45 a.m.

 

Matthew Cunningham: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 7-11-23 at 10 a.m. Defendant made a counter offer and State needs time to review same. If no resolution at next hearing, PTR hearing will be set.

Ronee Foraker: Defendant present with counsel and State's Attorney present. Joseph Hicks: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of theft (Count II). Count I dismissed per plea. Judgment of conviction entered. By agreement, Defendant sentenced to two years probation, 46 days in jail with credit for 23 days served, and he is ordered to pay the financial obligations set forth in the financial sentencing order. See written orders for additional terms. Hearing on the petition for waiver of assessments scheduled for in person hearing on 7-12--23 at 9 a.m.

 

Starla Hostetler: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $50,000 over objection of Public defender. Public defender has verified Defendant was medically discharged from inpatient treatment but has not returned to the jail.

 

Drakeem Manning: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing and hearing on the motion to reduce bond continued to 5-30-23 at 10 a.m.

 

David Moma: Defendant present with Public Defender and State's Attorney present. By agreement, plea hearing scheduled for 6-6-23 at 10 a.m.

 

Landon Moore: Defendant present with counsel and State's Attorney present. Over objection of the State, Defendant's motion to continue preliminary granted to illness of Assistant Public defender. Status on preliminary hearing scheduled for 6-12-23 at 10 a.m.

 

Patrick Motley: Defendant present remotely in custody with Public defender and State's Attorney present. By agreement, case called for hearing on application for recognizance bond based upon successful completion of inpatient treatment on furlough. Arguments heard. Over objection of the State, Defendant ordered released on a $50,000 recognizance bond subject to the terms of the pretrial release order. Pretrial hearing in all pending matters scheduled for 6-26-23 at 10 a.m. in person.

 

Laurie Reatherford: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 7-25-23 at 10 a.m. State made a plea offer and Defendant anticipates making a counter offer.

 

Jerry Riggs: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing and hearing on Defendant's motion for disclosure of confidential informants scheduled for 7-17-23 at 11 a.m.

 

Ronald Robinson Jr.: Parties present by counsel. Defendant was taken into custody by the Illinois Department of Corrections on a parole warrant. Preliminary hearing continued to 6-20-23 at 10 a.m. Sub to continue. In person writ to issue.

 

Fred Rutherford Jr.: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of theft. Judgment of conviction entered. By agreement, defendant sentenced to two years probation, 10 days in jail with credit for 5 day served, and he is ordered to pay the fine, assessments, and restitution. Petition for waiver hearing conducted. Defendant sworn and testifies. Petition granted. See written orders.

 

Layla Schuyler: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 6-23-23-23 at 10 a.m.

 

Cale Sexson: Defendant present with Public Defender and State's Attorney present. By agreement, under reduction motion hearing continued to 6-1-23 at 10 a.m.

 

Ryan Tarrant: Defendant present with PD Senger, who is granted leave to withdraw
due to conflict of interest tht developed while the case was pending. State's Attorney present. PD Herkert appointed to represent Defendant. By agreement, pretrial hearing continued to 6-15-23 at 10 a.m. Set case for trial now.

 

Trisha Weakley: Defendant present remotely in custody with Public defender and
State's Attorney present. Hearing on bond motion and petition to revoke scheduled for 6-2-23 at 10 a.m. Verified Application for Recognizance Bond or Reduction to an Attainable Amount filed by Public Defender Senger.

John Hott Jr.: Parties present by counsel. Status on sentencing set for 6-26-23 at 10 a.m. Notice to Appear to be issued.

 

Patricia Hornbuckle:  Defendant appears via Zoom with Attorney Erickson, State’s Attorney McWard also appears. On petition to modify bond to allow the Defendant to leave the state; State’s Attorney McWard objects and arguments are made via proofer. Defendant is allowed to leave the state of Illinois and go to the state of California as dictated in her written motion. Question of who is representing the State is still at question. State’s Attorney McWard indicates he is still trying to transfer this case to OSAP. The defendant waives the right to a speedy preliminary hearing; matter reset for Status Hearing on 5-23-23 at 1:00 p.m.

Special Prosecutor Kurtz is present; Defendant’s Attorney Erickson does not appear. Rest matter to 6-2-23 at 11:00 a.m.

 

Jacob Krouse: Defendant present in custody with PD Senger and State's Attorney present. Case called for category B bail review. Proffer made. Arguments heard. Defendant has 12 days of credit today or $360. Bond reduced to $10,000. He would need to post $640 today and it shall go down by $30 per day thereafter. Defendant ordered as a condition of release to have no contact with Frank Sedlock by any means.

Ashley Rockford: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of possession of methamphetamine. No judgment of conviction entered. By agreement, Defendant sentenced to two years first offender probation and she is ordered to pay the fine assessments as set the financial sentencing order. Bond from case 21-CM-136 is ordered to be transferred and applied. Petition for waiver granted. Defendant ordered released from custody and to immediate report to the probation department. Pay or appear hearing scheduled for 8-2-23 at 9 a.m.

 

Cale Sexson: Defendant present in person and in custody with Assistant Public Defender Grigsby and State's Attorney present. After admonishment, Defendant enters an open admission to the petition to revoke. The parties do not have an agreement as to sentencing. Probation Department ordered to prepare pre-sentence investigation report. In person sentencing hearing scheduled for 7-31-23 at 1:15 p.m. Defendant admonished regarding sentencing in his absence. Defendant to file bond reduction motion which is scheduled for hearing on 5-26-23 at 10 a.m.

 

Brett Walker: Defendant present with counsel and State's Attorney present. Christopher Carnahan: Defending preset with Public Defender Grigsby, State's Attorney present. PSC referral was pending, PSI ordered to be updated if it has not been yet. SFPT set for 6-12-23 at 10 a.m.

 

Steve Kampwerth: Defendant present pro se' and Havera present. Looking for compliance. Defendant is directed to take proof of compliance to probation office. Next hearing set for 6-13-23 at 10 a.m.

 

Jason Leach: Defendant present with Public Defender Grigsby, State's Attorney present, on status for fitness, parties stipulate to findings. Next hearing is set for 7-17-23 at 10 a.m.

The following court case was heard on May 19th, 2023:

Joshua Bain: Defendant present with Public Defender and State's Attorney present. Case called for hearing on Defendant's oral motion for furlough for drug treatment. Written order to follow with all details. Status 6-30-23 at 10 a.m.

 

Patrick Carr: Parties present by counsel. Defendant in treatment and parties have first offender probation plea ready once he completes treatment. Plea hearing 6-13-23 at 10 a.m.

Christian County Court Cases 05/18/2023

The following court case was heard on May 18th, 2023:

 

Sherrie Allcorn: Defendant present. Indicates that she has hired counsel but no entry has been filed. Set for hearing on pretrial on 6-26-23 at 11 a.m.

 

Tiffany Burke: Defendant present on Zoom with counsel. Reset for pretrial on 6-15-23 at 10 a.m.

 

Carl Carr: Defendant present with counsel. Count 2 filed. Count 1 is dismissed. Formal arraignment on Count 2 waived. Evidence heard on a STIP Proffer of Evidence. Court finds that the evidence substantiates the charges of Count 2 judgement on Count 2 entered against the Defendant. Terms 24 months probation consistant with the order entered today. No contact with Kimberly Pfieffer. $5,500 restitution order. $500 fine. Total fines and fees $7,039 in 2021CM48 the $500 bond is applied to any outstanding balances on other charges. Defendant to pay balance within 6 months. Reset for 11-22-23 at 9 a.m. 

 

Sean Curtis: Set for perliminary hearing today. Preliminary continued by agreement. Arraingment continued until 6-13-23 at 9 a.m.

 

Dale Detmers: First appearance on petition to revoke. Public Defender Singer appointed. Reset first appearance with counsel on 6-19-23 at 10 a.m.

 

William Dixon: Called on pretrial, failure to appear. Warrant issued on both cases pending. $5,000 bond, 10% to apply.

 

Dalton Dupont: Defendant present with counsel. Continued until 6-29-23 at 10 a.m.

 

Joshua Keathley: Defendant present and arraingned. Defendant to plead guilty in Count 1. Count 2 dismissed. Terms and judgement entered consistatn with the order entered on today's date. $1,349 fine and costs. Defendant to pay $25 per month starting 6-15-23. Payments monitored by probation.

 

Shannon Linder: Defendant set first appearance with counsel. Public Defender appointed. Case reset for preliminary on 6-2-23 at 9 a.m.

Defendant ordered released from custody and to immediately report to the probation department. By agreement, Taylorville Police Department is ordered to released Defendant's phone to him today. SP DePaepe's appointment vacated and Defendant knowingly and voluntarily waives any conflict of the State's Attorney repressenting the State while Defendant is in problem solving Court.

 

Jacob Snow: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of misdemeanor domestic battery (Count I). Count II dismissed pursuant to negotiated plea and with
the agreement of the alleged victim. Judgment of conviction entered. By agreement, Defendant sentenced to two years probation, 30 days in jail with credit for six days served, and he is ordered to pay the fine and assessments set forth in financial sentencing order bond to apply. Defendant to serve the remaining jail sentence on alternating weekends. See written orders.

Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of unlawful delivery of methamphetamine, an extended term, class 2 felony. No judgment of conviction entered. By agreement, Defendant sentenced to 2 years problem solving court (drug court). See written orders. Defendant ordered released from custody. Defendant sentenced to 179 days jail with credit for 279 days served.

 

Jason Bland: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of unlawful possession of methamphetamine, class 3 felony (Count I). Remaining counts dismissed per plea. No judgment of conviction entered. By agreement, Defendant sentenced to 2 years problem solving court (mental health court). See written orders. Defendant ordered released from custody. Defendant ordered released from custody.

 

Skye Halleman: Defendant fails to appear. Notice to appear to issue for 6-1-23 at 10 a.m.

For reasons stated on the record, bond reduced to $15,000 subject to the terms of the pretrial release order. See written order.

 

Kayla Durbin: Sheriff's office indicated original warrant not available -- they verified that the case was taken out of LEADS.

 

Ronee Foraker: Case called for hearing on Defendant's Motion for fulough for treament. Arguments heard. Motion denied for reasons stated on the record.

Robert Oliver: Defendant present with Public Defender and State's Attorney present. By agreement, first appearance and bond reduction motion (to be filed and State waives notice) for 5-2-23 at 10 a.m.

 

Bradley Stimac: Defendant present in person pro se and State's Attorney present. By agreement, hearing reset to 6-1-23 at 10 a.m. Defendant found in direct criminal contempt for language used in court. Defendant apologizes and court accepts same and declines to impose any jail time. Defendant needs to provide a clean drug test for sealing per statute.
