Christian County Court Cases 11/29/16

These are the results of the following court cases heard on Tuesday, November 29th at the Christian County Courthouse.

 

15CF061 - Johnston, Brodan S - PreTrial - Defense has reviewed defendant’s complaints regarding his sentence. Requested an amended sentence. Defense will withdraw postjudgment motions.

 

16CF163 - Logsdon, Bobbie J - PreTrial - Problem solving court referral has been made. Defendant has talked with probation about the program. Mental health assessment has been made. Court said defendant should go to probation after court to find out what else needs to be done.

 

16CF093 - McKay, Justin M - PTR/PreTrial - Defendant has received a bed for treatment and has been transported on a furlough for drug treatment. Matter continued until December 20th.

These are the results of the following court cases heard on Monday, November 21st at the Christian County Courthouse.

 

16CF202 - Emery, Michael W - Motion Hearing - Defense has a motion for furlough. Defense says they have a serious drug and alcohol problem and would like to go to rehab. State objects to motion due to nature of charges. Court orders probation to help defense determine if he truly needs treatment. Said he normally doesn’t grant furloughs for cases with violence charges, but will be willing to let defendant try to get into a rehab facility and will reconsider at that time.

15CF117 - King, Jason M - PTR/PreTrial - State requests matter be set for hearing. Defense would like to speak with probation officer to see if they need a hearing. Court sets it for PTR hearing for December 13th.

 

16CF007 - Kohl, Jay P - PreTrial - Negotiated plea reached. Defendant would plead guilty as charged. Sentenced to 2 years probation.

 

16CF080 - Lee, Natasha J - PreTrial - Set for further court date for February 6th.

 

16CF165 - Reiss, Chad M - PreTrial - Defense had requested copies of affidavit and search warrant. Defense still considering filing motion on search warrant. Moves to continue case so defense can prepare said motions. State has no objections. Set for January 5th.

 

16CF229 - Ferguson, Brian - First Appearance - Defense read charges and possible penalties. Bond set at $250,000. Defendant says he wishes to try to figure out bond and then potentially hire an attorney. Another court date set for December 2nd to find out the status of bond and hiring counsel.

16CF086 - Archer, Jerry D - Prelim Hearing - Defense moves to continue prelim hearing. State provided discovery to defense, in which there is a witness that is represented by public defender. May be conflict of interests in the case. Public defender may file motion to recind counsel. Set for prelim hearing January 3rd.

 

15CF045 - Shanks, Dakoda B - PTR/PreTrial - Defense moved to continue for 30 days. Set for further pretrial.  January 6th.

 

16CF089 - Steele, Donnie S - PreTrial - Defense asks for continuance of trial date to next available date. Set for trial January 30th. Final pretrial set for January 17th.

16CF222 - Bailey, George T - Prelim Hearing - Defense waives prelim hearing. Waive formal arraignment and enter plea of not guilty. Requests trial by jury. January 30th for Jury trial. January 19th for pretrial.

 

14CF154 - Boyle, Joshua Zachary - PreTrial - Continued until January 6th.

 

16CF227 - Cowell, Douglas W - Appearance with Counsel - Counsel doesn’t do criminal matters. Defendant requests public defender. Some debate on whether or not defense qualified for public defender, but court ultimately finds that he doesn’t qualify. Next court date set for Monday.

 

16CF213 - Lacy, Jessie - PreTrial - Plea deal not reached and defendant not able to post bond. State has agreed to a recognizance bond. State and defense working on a plea deal. State confident they can come to an agreement soon. Set for possible plea December 1st.

 

16CF180 - Lynch, Joshua L - Appearance with Counsel - Court date set for January 6th.

 

16CF128 - Newman, Devon J - PreTrial - Defence negotiating with state. Next court date set for January 6th.

 

16CF216 - Pitsch, Lance T - Prelim Hearing - State has filed additional counts with the matter. State calls Special Agent Eric Weston with the Illinois State Police to the stand. Testified that he was contacted to assist in the investigation of a wreck on Il Rt 48. His team observed a pickup rolled on it’s side in the north side ditch and a white honda facing the wrong way in the southbound lane. Testified that a witness vehicle said they viewed the pickup weaving across the road and witnessed the accident. Gave a positive identification of the defendant. Testified that the driver, Nester Lopez received several serious injuries, and Jessica Tyson-Ragan received fatal injuries. Testified that autopsy showed that Tyson-Ragan was pregnant at the time of the crash. Testified that an officer investigating a possible DUI charge went to the hospital where Pitsch was transported to, and was told that the defendant had underwent a medical blood draw for his injuries, which showed a blood alcohol content of .373. Defendant was offered a separate blood and urine test. Weston was called to interview defendant, where he asked Pitsch to go over his day of the crash. Said he woke up and traveled to Taylorville area to hunt. Said he was drinking vodka while hunting. Said he eventually left and gotten lost. Said Pitsch said he was putting in an address in his GPS when he looked up and realized he was heading off the road, and that he didn’t remember much after that. Said he kept his vodka in a water bottle that he drank throughout the day. Weston testified that while he was interviewing Pitsch, it was apparent Pitsch was still under the influence of alcohol. State argued for probable cause to be found on counts 1-5. Court finds probable cause on all counts for case to proceed to trial. Defense waives formal arraignment as to content of charges, but wanted to go over the charges and possible penalties. Defendant pleads not guilty to charges. Jury trial set for February 27th at 8:30. Further pretrial set for February 9th at 11am.

 

16CF219 - Purcell, Kevin M - Prelim Hearing - Defense waives prelim hearing. Defense waives formal arraignment and enters plea of not guilty. Requests trial by jury for late January. Set for Jury trial January 30th. Pretrail set for December 15th.

15CF034 - Davis, Shawn T - PTR/PreTrial - Defendant in treatment. Defense would like to set matter for hearing. Set for hearing on PTR December 15th.

 

13CF193 - Dodd, Ashley L - Status - Reset for November 18th.

 

16CF009 - Ellis, Keri C - PreTrial - Defense has asked for referral to mental health court. State won’t reject out of hand but do want to see assessments first. Waiver of jury trial and request for bench trial signed by defendant. Referral to be made today.  

 

16CF197 - Wilkerson, Lonnie R - PreTrial - Same charge also filed in Sangamon County. State will have an offer for defense once they contact Sangamon County. Set for final pretrial November 28th.

 

16CF197 - McKinnon, Angela N - Motion Hearing -  Motion hearing rescheduled for 1:15 pm November 21st.

16CF220 - Doud, Destiny E - Prelim Hearing - Defense waives prelim hearing. Waives formal arraignment and enters plea of not guilty. Demands trial by jury. State has made offer to co-defendant, and defense would like to also receive an offer from the state. Defense prepared to waive speedy trial in order to work out a deal. Didn’t request jury trial date, just pretrial. Pretrial set for December 20th.

Christian County Court Cases 11/14/16

These are the results of the following court cases heard on Monday, November 14th at the Christian County Courthouse.

 

16CF222 - Bailey, George T - Motion Hearing - Defense has filed motion to modify bond conditions. Defendant’s wife wants defendant to come home and have no contact order with no entry provision lifted. Pretrial release order vacated, taking away all no contact provisions. Next court date set for Friday.

 

16CF147 - Cushing, Lyndon J III - Status - Defense seeking problem solving court referral. Mental health evaluation hasn’t been completed. Everything else however has been completed. Continued until Wednesday.

 

16CF196 - Hayes, Gary R JR - PreTrial - State and defense negotiating. Issues with the case with pending charges in Sangamon county. State requests further time to see if there can be a negotiated plea. Defense would like to complete negotiated plea in Christian County before defendant deals with Sangamon County issues. Continued until November 28th.

 

16CF117 - Hedrick, Mark A - PreTrial - State has made an offer to defendant. Defendant also may not be showing up to probation testing. Defense says defendant has broken his leg, and has no way to make it to probation. There’s also evidence pictures that defense wants to see. State will provide any discovery pictures to defense. Next court date November 29th.

 

16CF171 - Loyd, Brian E - PreTrial - Defense moves to continue pretrial and jury trial setting. No objection from state. Set for jury trial January 30th. Final pretrial set for January 19th.
