16CF229 - Ferguson, Brian K - Prelim Hearing - State calls Jason Cole with the Pana Police Department to the stand. Testified that he responded to a call from someone who had said Ferguson had cut his own throat and set her house on fire. When he arrived at the scene the house was fully engulfed in flames. Said the homeowner said she found Ferguson at the residence with a boxcutter and a gas can, and told him to leave. Said Ferguson assaulted her and held her down on her bed. Said she informed investigators that he wanted her to watch as he inflicted harm to himself. Victim was able to escape and run to the neighbors house. During escape she witnessed Ferguson setting fire to her home. Officer Cole testified that Ferguson had arrived at a neighbors home already covered in blood, grabbed a box cutter then left. Officer cole positively identified Ferguson in court. Testified that Chief Bland viewed Ferguson, who made motions towards Bland to stay back, before entering his own residence. Testified that an Illinois Police SWAT team knocked down Ferguson’s front door after which Ferguson came to the door and collapsed. A search warrant was obtained and officers found a boxcutter with blood on it, as well as Ferguson’s clothing that smelled of gasoline. During cross examination Officer Cole stated he knew that the victim owned the residence. Testified that Ferguson did not make any verbal threats towards victim, and the only verbal threats were for him to harm himself. Said there was force used however to enter residence and to restrain victim. State argues that probable cause should be found based on the testimony given by Officer Cole, and several previous court cases with results pertinent to this case in regards to issues of home invasion and threatening someone with a deadly weapon. Court finds that probable cause does exist to bring the case to trial. Defense waives formal arraignment and enters plea of not guilty. Requests a February trial date. Set for jury trial

 

15CF072 - Millburg, Sherry L - PTR/PreTrial - Defendant has the flu and doesn’t appear in court. No history of FTAs. Defense moves to continue case.


16CF228 - Thompson, Antonio L - Status on Hiring Counsel - Defense has not been able to find counsel and asked for a continuance. Said he’s been in contact with several attorneys and needed time to get the funds together to hire one. Set for January 27th for potential first appearance with counsel.

13CF193 - Dodd, Ashley L - PreTrial - State received an offer from the state, to which the defendant will reject. Case needs to be set for sentencing. Defendant asking for a furlough for drug treatment. State objects to a furlough. Court denies request for furlough. Set for sentencing February 9th.

 

16CF009 - Ellis, Keri C - Status - Defense makes problem solving court referral and defense met with probation yesterday. State hasn’t decided how they’re going to stand. Defense asks for continuance. Continued until January 17th.

 

16CF223 - Prakel, Richard D - Prelim Hearing - Defense waives prelim hearing.

 

16CF231 - Prakel, Richard D - Prelim Hearing - State calls Aaron Reimann with the Taylorville Police Department to the stand. Identified defendant. Officer said during a traffic stop, he asked defendant to exit the vehicle, due to movements he kept making towards his sweatshirt pocket. Defendant said he was sitting on a BB gun. Once he got out the officer patted him down and viewed a coffee filter in the vehicle. Asked the defendant about it and defendant said he didn’t know anything about it. Said often when methamphetamine is cooked it’s stored in a coffee filter to dry out. Received consent to search the vehicle, and said he found various pills and drug paraphernalia during the search, as well as a second bb gun. State submits pictures of the evidence to the court. Defense asked Officer Reimann several questions as well. Court finds probable cause today. Defense waives arraignment on all charges, and denies PTR on any case where it hasn’t already been denied. Defense requests January trial date. Set for January 30th.

Christian County Court Cases 12/13/16

16CF217 - Bayne, Markee M - Prelim Hearing - Motion by state to nolly the charge. Court allows it.

 

16CF229 - Ferguson, Brian K - Motion to Reduce Bail - Motion for bond reduction as well as a motion to have a psych evaluation done. No objection from state for motion for evaluation to be done by a psychiatrist. Motion granted. Defendant testifies on motion for bond reduction. Testified that he’s lived in Pana his whole life, and would continue to stay there upon release. He does have a prior criminal record, but has completed parole, and hasn’t committed any other offenses, and has never failed to appear in court. Defendant says he has no ability to post bond, and that he is receiving social security and disability, and if he is incarcerated he will lose those benefits. Would agree to electronic monitoring should he be released. Defense asks for bond to be set in an amount the defendant can pay, or to be released on recognizance. State disagrees with any bond reduction, reiterating the seriousness of the case and the defendant’s prior record. Also stated how defense started to make a scene upon entering court this morning. Motion for bond reduction denied. Court believes based on the seriousness of the offenses that bond is appropriate. Prelim hearing set for the December 16th.

 

16CF235 - Floyd, Joshua T - Motion to Reduce Bail - Defendant has bonded out so the motion for bond reduction is no longer necessary. Case reset for January 3rd.

 

13CF200 - Gatton, Danielle M - Status - State given a violation report. State requests PTR to be filed due to an outstanding balance that needed to be paid off. Defendant hopes to use her income tax to pay a portion of the balance, and hopes to have the rest of the balance paid off by May. State agreeable to continue PTR and leave the matter pending until she can pay something with her income tax. State requests a payment plan be set up. Payment plan set up, with first payment set for January 1st. Payment review set for March 1st.

Christian County Court Cases 12/12/16

These are the results of the following court cases heard on Monday, December 12th at the Christian County Courthouse.

 

16CF162 - McKinnon, Angela - Motion to Reduce Bond - Defendant testified that she has lived in Christian County her whole life, as well as her education completed. Said if allowed a recognizance bond she would live with her grandparents in Kincaid. Also testified that her previous employer has indicated that they would bring her back if released, and that she would only use a car to get to and from work, and will agree to wear an ankle bracelet and will comply with all drug treatment. Also said she’s been a positive influence while incarcerated, and that corrections officers have complimented her on such. Said she would also stay in contact with the probation department for all drug screenings and to make sure she’s complying with all release conditions. State asked questions regarding her residence should she be released, her relationship, and her employment. Also testified that she has no income or savings. Defense argued that bond was set due to the Class X felony that has since been dismissed, and they wish for bond to be set in regards to the charge she’s since plead guilty to. Defense asks for a recognizance bond with release conditions to apply including a monitoring device and orders to report to probation for drug testing, and stated that she presents no evidence that she would be a flight risk. State says that a recognizance bond isn’t appropriate due to the fact that it’s still a class 2 felony. State has no objection to a reduction of bond to $100,000 or 10% to apply, with conditions of no drugs or alcohol to apply. Also argued prior evidence presented during prelim hearing that she doesn’t intend to change her behavior, and that heroin addicts often overdose once released, and that the fact that she would stay with her grandparents once released is worrying considering that’s where she lived when the offense took place. Defense argues that for class 2 felonies from first offenders, recognizance bonds aren’t unusual, and that even a $100,000 bond would be unusual. State says they would file a source of bond motion regardless of who posts bond. Court grants motion to reduce bond to $100,000 with special terms and conditions to remain.

16CF058 - Crowder, Christian - PreTrial - Defendant was released from VA hospital on November 29th. Defense has gotten verification of that, and says they aren’t sure if defendant was aware of the court date and that they will notify him of the next court date. No objection from state. Next court date set for January 13th.

 

15CF016 - Klyber, Amanda J - Motion Hearing - Defense asking for additional 30 day period so she can work out some issues regarding payments. No objection from state. Next court date set for January 12th.

 

16CF106 - Page, Vincent B - Status - Defendant has been an applicant for specialty court, but has been denied. Currently on ankle monitor. Agreement reached to remove monitor and moves to continue case for possible plea. Next court date set for January 19th.

 

16CF092 - Patnode, Danielle E - PreTrial - State and defense has agreement to bond. Defendant will be released on $10,000 recognizance bond and will be fitted for electronic home confinement. Will be released for medical reasons as well as for DCFS visits with children. Defense still waiting for lab results from crime lab. Lab is currently 6 months behind. Probation office will assist defendant with finding residential treatment once it’s available. Next court date set for January 5th.

16CF226 - Rozplochowski, Pamela J - Prelim Hearing - State calls officer Aaron Reimann with the Taylorville Police Department to the stand. Testified that he was dispatched to the lobby of TPD for a stolen vehicle report. Said he spoke with a couple who said their son took their vehicle to wrestling practice, left the keys under the center console, and when he returned the vehicle was gone. Also spoke with the couple’s son, and the Taylorville High School Principle. Said the parents had called the TPD saying a friend of the son had seen the vehicle, and had a description of the male and female in the vehicle. Officers later found male and female, and identified the female as defendant. Defendant was interviewed on scene and after being taken into custody. Said she was with another party who she said she believed she had taken the truck. Other party said she should take the truck for a while. Later encountered a party who said the vehicle was stolen and that she was calling the police. Defendant got scared and ditched the vehicle. Defense asked several questions asking if any of the witnesses identified the defendant to which they had not. Also asked if there was any hard evidence showing the defendant stealing the vehicle, and if she knew the vehicle had been stolen. Probable cause found. Defense waives formal arraignment and requests jury trial and pretrial. February 22nd set for Jury. February 16th set for pretrial.

 

16CF044 - Sklenka, Brett M - PreTrial - Defense moves to continue pretrial and jury trial. State needs a motion from defense for some information they have. No objection from state for the continue of the dates. January 20th for pretrial. February 27th for jury trial.

16CF092 - Patnode, Danielle E - PreTrial - Defense trying to work out conditions of electronic home confinement. Defense moves to continue until Thursday.

 

16CF193 - Cunningham, Matthew Z - Status - Recently placed on probation in a different case. State makes a motion to dismiss case. No objection from defense. Case dismissed.

 

16CF233 - Girard, Jennifer A - First Appearance - Defendant read charges and possible penalties. State seeking bond, and read evidence for probable cause to be found, stating how officers with the Taylorville Police Department stopped defendant on a traffic stop, where defendant gave a false name, and was placed under arrest. Officers while arresting defendant found substance that tested positive for methamphetamine on her person. Court finds probable cause and sets bond at $20,000. Defense requests public defender. Public defender assigned. Next court date set for Tuesday at 10am.

 

16CF162 - McKinnon, Angela - Partial plea - Defendant pleads guilty to count 2. Count 1 dismissed. State has discussed the plea with the mother of the victim, and state says she understands reason for count 2 plea, and is on board with the state’s plea recommendation. Police Chief Wheeler with the Kincaid police department has also indicated that he’s on board. Count 2 is a class two felony, which holds a prison sentence of 3-7 years, followed by 2 years of mandatory supervised release. Could also be fined up to $200,000. Defendant also explained to by court that the possible sentence for Count 1 would have required up to 75% of the sentence served, while count 2 holds a required time served of 50%. State gave factual basis behind the plea agreement, saying that if the case were to go to trial, the state would provide evidence from the testimony of Kincaid Police Chief Wheeler during the preliminary hearing, as well as other parties involved in the case, including the mother of the victim. Other evidence would have been shown as well including information from McKinnon’s Facebook profile and text message records acquired through a search warrant that indicated that McKinnon sold heroin to victim prior to the victim’s overdose, and that she was worried she’d be charged with murder once she learned of victim’s death. Defense disputes any and all connections in factual basis read by state that attempts to connect McKinnon to victim’s passing, and will fight that connection during sentencing. State responds that there’s more than enough evidence for Count 2, and the rest can be taken up during sentencing. Court finds a factual basis for the guilty plea on Count 2. Court orders pre-sentencing investigation. Sentencing set for January 26th at 1:15pm. Defense has filed a motion for bond reduction for release on recognizance bond, with a motion hearing set for Monday, December 12th.

16CF229 - Ferguson, Brian K - Appearance with Counsel - Defendant has filed a motion for bond reduction, proceeded on the motion representing himself. Says he would like a reduction in bond because he’s a partial caregiver and cannot make contact with the people he needs to to help with bond. State opposes any reduction in bond due to the nature of the charges. Stated part of the reason for bond is for the protection of the public, and defendant has threatened a member of the public and harmed himself in the process. Defendant stated that he’s not a criminal. Motion for bond reduction denied. Matter set for preliminary hearing for December 16th, and defendant will continue to represent himself.

 

16CF196 - Hayes, Gary R Jr - PreTrial - Negotiated plea reached. Defendant pleads guilty as charged. Sentenced to 2 years probation. Sentenced to 180 days in the Christian County Jail with credit for 90 days served. Will also pay all applicable fines and fees.

 

15CF130 - Johnson, Jarod A - Arraignment - Negotiated plea reached. Defendant pleads guilty. Conviction will enter that defendant will be placed on 2 years probation. Defense asked that the probation order be modified to allow defense to move to Tennessee should the probation be able to be transferred.

 

16CF055 - Johnson Jarod A - Arraignment - Negotiated plea reached. Case dismissed per to plea in 15CF130.

 

16CF139 - Stephens, Colt A - Plea - Negotiated plea reached for courts consideration. Defendant pleads guilty. Sentenced to 2 years in the Illinois DOC with 1 year supervised release with credit for 10 days served.

 

16CF197 - Wilkerson, Lonnie R - PreTrail - Negotiated plea reached. Defendant pleads guilty as charged. Sentenced to 2 years probation. Sentenced to 180 days in the Christian County Jail with credit for 90 days served. Will also pay all applicable fines and fees.

Stated he was involved in an investigation on a hit and run. Said he arrived to see defendant’s car damaged in the roadway. Said he had to tow the vehicle and that defendant had stated he was driving. Testified he found a loaded pistol in the passenger floor board. Said defendant did not have a valid concealed carry license in Illinois at the time of the offense. Court finds probable cause.
