Christian County Court Cases 05/15/2023

The following court case was heard on May 15th, 2023:

 

Shawn Evans: Defendant present pro se and State's Attorney present. Defendant did 4 hours and has 5 hours left. Pretrial set 6-23-23 at 10 a.m. If Defendant gives proof of completion of public service were to his probation officer who will to the State before the next hearing, Defendant need not appear and the State agrees to withdraw the petition to revoke at that time.

 

Cody Fringer: Defendant present pro se and State's Attorney present. Defendant still is in the process of completing counseling. By agreement, case continued for first appearance to 7-11-23 at 10 a.m. in person.

 

Bradley Graham: Defendant present with Public Defender Rahar and State's Attorney present. By agreement, preliminary hearing scheduled for 6-1-23 at 10 a.m. in person.

 

Alonzo Hoyer: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing scheduled for 6-16-23 at 10 a.m. State did answer discovery and made plea offer. Defendant has sentencing hearing in Effingham County 6-12-23. They did not writ him for the May date.

 

Shannon Linder: Defendant present eith PD Senger, who appears solely for the initial appearance and bond hearing. Defendant represented by attorney Calvert in other, pending matters and Defendant may hire him in this case. State's Attorney present. Defendant admonished regarding
charges and possible penalties. Proffer made. Probable cause found. Bond hearing conduted. Arguments heard. Court finds cash bond appropriate in the amount of $150,000. First appearance with counsel set for 5-18-23 at 10 a.m.

 

Dennis Lowe: Defendant present in custody on new charges with Assistant Public Defender Grigsby who is appointed to represent him. State's Attorney Present. Defendant admonished regarding charges and possible penalties. Proffer made. Probable cause found. Bond hearing conducted. Arguments heard. For reasons stated on the record, court finds cash bond appropriate in the amount of $10,000. Preliminary hearing scheduled for 5-30-23 at 10 a.m.

 

Austin Mayes: Defendant present remotely in custody with counsel and State's Attorney present. Case called for hearing on fitness. Parties stipulate to the admission of the report of Dr. Killian. Based upon that evidence, the Court finds Defendant is unfit to stand trial and there is a substantial probability that he can be restored to fitness within one year with treatment in the Department of human services. See written order. Status on initial report scheduled for 6-19-23 at 10 a.m. See written order.

 

Dustin Meseke: Defendant present remotely with Public defender. State's Attorney Present. Preliminary hearing is set for in person hearing 6-30-23 at 10 a.m. Defendant in treatment for physical issue. Defendant to contact OSPS. By agreement, pretrial drug testing requirement vacated.

 

Donald Minard: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 9-19-23 at 1:15 p.m. Jury trial scheduled for 10-2-23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Mitchell Neece: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 6-15-23 at 10 a.m. Case called for hearing on Defendant's Motion for Bond Reduction. Defendant sworn and testifies. Arguments heard. Motion denied for reasons stated on the record.

 

Kaile Overby: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 6-19-23 at 10 a.m.

 

Tyrone Powyszynski: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 9-19-23 at 1:15 p.m. Jury trial scheduled for 10-2-23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Jacob Samson: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of aggravated domestic battery. Alleged victim does not object. By agreement, judgment of conviction entered and Defendant sentenced to two years probation, 50 days in jail credit 50 days served and he is ordered to pay the fine and assessments set forth in the financial sentencing order. Cale Sexson: Defendant present with Public Defender and State's Attorney present. By agreement, PTR hearing set 5-23-23 at 10 a.m.

 

Jack Skinner: Defendant present in person in custody with Assistant Public Defender Grigsby and State's Attorney present. By agreement, motion for furlough granted upon bed availability. status of furlough and preliminary hearing status set 6-15-23 at 10 a.m. Written order to follow.

 

Robert Tipps: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of agreed sentence on 6-23-23 at 10 a.m.

 

Charles Warren: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 6-27-23 at 10 a.m.

 

Dean Weller: Parties present by counsel. Defendant still in treatment. Status of treatment and status of preliminary hearing scheduled for 5-22-23 at 10 a.m.

 

Chad Wilber: Defendant present with Public Defender and State's Attorney present. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 7-17-23 at 10 a.m.

 

Nathan Wiseman: Defendant fails to appear. Notice to appear to issue for 5-23-23 at 10 a.m.

 

 

Jordan Young: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury. Pretrial hearing scheduled for 8-22-23 at 10 a.m. Writ continued.
