Christian County Court Cases 8/31/17

These are the results of the following court cases heard in the Christian County Court on Thursday, August 31st:

 

17CF152 - Nathaniel Z. Bain - 2 Counts of Narcotics Possession - Preliminary Hearing. Preliminary hearing is waived. Formal arraignment is waived. Defendant pleads not guilty and requests trial by jury in October. Trial scheduled for October, pre-trial scheduled for September 18 at 10 a.m.

 

17CF123 - Dylan L. Carroll - Aggravated Battery - Pre-trial. Also 16CF204 - Criminal Damage to Government Property Less Than $500, 16CF091 - Threatening a Public Official and Resisting a Peace Officer, and multiple traffic charges. Amended bond motion set for today. Because Judge Paisley is out, defense requests motion be pushed back to September 7 so he is here. Next court date scheduled for September 7 at 10 a.m.

 

17CF057 - Gabriel I. Crews - Forgery - Preliminary Hearing. Also multiple traffic charges. Alan Mills with Taylorville Police Department called as witness. Probable cause is found. Formal arraignment is waived, defense requests trial by jury. Defense asks for November trial. Trial scheduled for November, pre-trial scheduled for October 23rd at 10 a.m.

 

17CF071 - Josh D. Hill - Meth Delivery Between 15 and 100 grams and Meth Delivery Between 5 and 15 Grams. Pre-trial. State has given defendant an offer. Pre-trial continued until October 5 at 10 a.m.

 

17CF085 - Tracy J. Kennedy - Possession of a Controlled Substance - Pre-trial. Also 17CL045 - Possession of Drug Paraphernalia - Clerk Review. Both sides agree to continue pre-trial until November 2 at 10 a.m.

 

17CF182 - Melinda D. Kraut - Possession of Meth Less Than 5 Grams and DUI - First Appearance with Counsel. Preliminary hearing requested and immediate bond hearing. Defendant testifies on her own behalf. Bond motion is denied, but it can be renewed. Next court date scheduled for September 21 at 10 a.m.

 

17CF051 - Charles T. Lee - Meth Delivery Between 15 and 100 Grams and Aggravated Meth Delivery Between 15 and 100 Grams - Pre-trial. Trial continued until October. State has made a new offer to defendant. Pre-trial bond motion hearing scheduled for September 8 at 10 a.m.

 

15CF240 - David L. Robinson - Theft Between $500 and $10,000 - Preliminary Hearing. Additional discovery is coming. Next pre-trial set for October 17 at 10 a.m.

 

16CF226 - Pamela J. Rozplochowski - Possession of a Stolen Vehicle - Status hearing. Also 16CF104 - Theft Less Than $500 With a Prior and 16CF021 - Retail Theft Less Than $300. She does not appear. Warrant already out for her arrest on a separate case, this case added to that warrant over defense counsel objection.

 

17CF178 - Joshua M. Sams - Retail Theft Less Than $300 - First Appearance. Also 16CF010 - Retail Theft Less Than $300, 17CM007 - Retail Theft Less Than $300, and two traffic charges. Open plea is reached. Charge in 17CF178 will be dismissed. He will plead guilty to charge in 16CF010. Status hearing scheduled for October 19 at 10 a.m.

 

16CF125 - Brittany N. Scribner - Aggravated Use of a Communication Device While Driving Resulting in a Death - Negotiated Plea. Also a traffic charge. Defense counsel is ill and not present. Rescheduled for October 3 at 9 a.m.

 

17CF028 - Toni K. Sherman - Aggravated Battery - Pre-trial. Plea and sentencing scheduled for October 17 at 10 a.m.

 

17CM051 - Joey L. Shoraga - Domestic Battery - Pre-trial. State has made an offer. Pre-trial and possible plea continued until September 28 at 10 a.m.

 

17CF179 - Shiloh K. Thomas - Domestic Battery With a Prior - First Appearance. Charge was read. Public Defender was appointed. Recognizance bond of $5,000 set. Next appearance scheduled for October 19 at 10 a.m.

17CF150 - Ashli N. Brumberlow - 2 Counts of Meth Delivery Less Than 5 Grams - Preliminary Hearing. Preliminary hearing is waived. Formal arraignment is waived. Defendant pleads not guilty. Jury trial requested and scheduled for December. Final pre-trial set for November 20 at 10 a.m.

 

17CF002 - Treylon L. Fuller - Possession of Stolen Firearm and Manufacturing / Delivery of Cannabis Between 30 and 500 Grams - Pre-trial. Negotiated plea is reached. He would plead guilty to stolen firearm charge. He would be sentenced to 60 days in jail and two years probation. Factual basis is given. Cannabis charge is dismissed as part of the plea.

 

17CF035 - Brett R. Grant - Possession of Meth Less Than 5 Grams - Pre-trial. Case is dismissed.

 

13CF208 - Tanya K. Mansfield - Manufacturing / Delivery of Cannabis Between 10 and 30 Grams and Narcotics Possession - Pre-trial. Not here. Warrant issued. Bond set for $50,000.

 

17CF022 - Justin L. Marlow - Domestic Battery With a Prior - Pre-trial. Also 17CM017 - Criminal Trespassing to State Land. State looking to push jury trial back because of reluctant witness. Defense objects. Jury trial continued until October, pre-trial scheduled for September 25 at 10 a.m.

17CM074 - Randy L. Sparling - Criminal Damage to Property Less Than $500 - Pre-trial. State has made an offer, defense made counteroffer. Pre-trial Continued to August 30 at 10 a.m.

 

17CM062 - Francis M. Weber - Obstructing Identification - Negotiated Plea. - Also two traffic charges. He will plead guilty to all of the charges. He is sentenced to 30 days in the county jail. Next court date scheduled for November 15 at 9 a.m.
