Christian County Court Cases 1/30/17

These are the results of the following court cases heard on Monday, January 30th, at the Christian County Courthouse.

 

14CF182 - Klauser, Jodie M - PTR/First Appearance - State alleges that defendant has failed to pay the fines and court costs associated with his probation, and that the last payment was made in May. Defendant asked for time to speak with the state regarding the matter.


17CF018 - Rensman, Kevin M - First Appearance - Defendant charged with aggravated battery, causing great bodily harm. Defendant eligible for extended term sentencing, meaning defendant could face 2-10 years in the Illinois DOC with 1 year of mandatory supervised release. Also charged with an unlawful violation of an order of protection. Could face up to 364 days in prison. State argues for probable cause for bond to be set at $100,000, with special terms and conditions to apply, saying that officers responded to a call, and found victim in the case to be tending to a wound that was bleeding extensively. Said the accused became angry with him due to him speaking with an ex girlfriend of the accused, and stabbed him. A knife was recovered from the defendant. State also requested court to review the details of the OP order that was violated, and said that due to testimony from witnesses, they believe that drugs or alcohol were a factor in the matter as well. Court sets bond at $50,000 with special conditions to apply. Public defender appointed. Defendant did say that he was struck with a pipe by the other party in the battery charge. Next court date set for January 31st.

2014CF0009 Jacob G. Fahl - Pre Trial for Criminal Damage to Property - Postponed to 02/14

 

2016CM0125 Amelia R. Akins - Pre Trial for Retail Theft -Defendant currently under counseling that attorney said could affect outcome of the case. Case moved to March 14th at 10am

 

2016CF0086 Jerry D. Archer - Appearance with Counsel - Scheduled preliminary hearing for March 23rd at 10am.

 

2015CF0034 Shawn T. Davis - Pre Trial for Burglary - Petition to revoke probation filed yesterday. Judge Pasley asked for substantial progress and change on defendant’s part to show improvement based on past charges, otherwise there will be a sentencing hearing to possibly be sent to Department of Corrections. The court reminded Davis that they do not have interest in sending him to prison, but they need effort on the defendant’s part to show an improvement and interest in getting help with drug addiction. Defendant admitted 2nd amended petition to revoke probation, Sentencing Hearing set for March 23rd at 1:15pm.

 

2017CF0001 Thomas MJ. Foster - Preliminary Hearing - Defendant requested Pre Trial. Next notice to appear is March 13th at 10am.

 

2013CF0220 Trent A. Lebon - Pre Trial for Criminal Sexual Assault - Defendant, per attorney is in compliance with all State's wishes and completed sex offender counseling. Pre trial hearing set for February 16th at 10am.

 

2016CF0106 Vincent B. Page - Pre trial for Meth Manufacturing - Hearing set for February 23rd at 10am.

 

2016CM0220 Dana. R Perkins - First Appearance - Defendant proceeded to plead not guilty and ask for jury trial which is scheduled for March 14 at 10am.

 

 

2016CF0126 - 2017CM0021 Dwain E. Sarver - Pre Trial & Appearance with Counsel for charge of Battery of a Peace Officer & Resisting a Peace Officer - Defendant plead guilty to the Class 2 felony and was sentenced to the Department of Corrections for 3 years, followed by 2 years of mandatory supervised released with credit for 30 days served. Misdemeanor in this case is dismissed as a part of the guilty plea. No fines recorded in this case after a previous bond was posted so those monies will be refunded to the party that originally posted the bond.

Christian County Court Cases 1/23/17

These are the results of the following court cases heard on Monday, January 23rd at the Christian County Courthouse.


16CF237 - Stimac, Bradley S - Prelim Hearing - State calls Police Chief Dwayne Wheeler. Says he was conducting surveillance in reference to a narcotics trafficking call, when he saw defendant exit a vehicle at the residence he was watching. Asked dispatch to do a warrant check and discovered a warrant for defendant. Wheeler activated his body camera and conducted a traffic stop, and placed defendant under arrest. Says defendant seemed nervous and that he was under the influence. Asked defendant if there was anything in the car. Defendant initially said no, but later indicated that there was meth in the center console. A search was conducted and police recovered several bags of meth. Says defendant said he was selling meth to make money and support his habit. Defense asked Chief Wheeler read him his “Miranda rights”, and Chief Wheeler says that he had not. Says defendant voluntarily gave information on the drugs. Says the search was conducted on the vehicle due to that information. State asks probable cause to be found due to the testimony from Chief Wheeler. Defense makes no argument to probable cause. Court finds probable cause. Defense waives formal arraignment and request trial by jury. Set for pretrial on February 7th.

Christian County Court Cases 1/20/17

These are the results of the following court cases heard on Friday, January 20th at the Christian County Courthouse.

 

17CF009 - Beyers, John E - First Appearence - Defense requests prelim hearing. Prelim hearing set for March 17th.

 

17CF008 - Bright, Justin M - Appearance with Counsel - Defense requests prelim hearing, and has a motion for bond reduction set for Monday. Asked if state was willing to hear that today and they were. Defendant testified that if released, he would reside in Taylorville. Defense does have a criminal offense on his record. Not currently on parole or supervised release. Hasn’t had any drug offenses. Currently employed full time, and would return to work if released. Currently has no money for bond, but has two vehicles he could possibly sell for bond. Has $15,000 bond, and defendant asking court for release on recognizance. Defense argues that defendant could have restrictions placed on him to monitor him, and asks to allow him to return to work. State believes bond is set reasonably. Court orders defendant be released on recognizance with restrictions of not ingesting any illegal drugs or synthetic substances. Will be subjected to random drug testing. Also placed on electronic home confinement. Defense waives prelim hearing, and requests a February pretrial. Pretrial set for February 13th.

 

15CF232 - Caulk, Darren E - Status - Defendant saying he should have been given credit when he plead guilty for 52 days served. Court strikes motion saying that he has been given credit for the time served.

 

16CF034 - Clardy, Richard A Jr - PreTrial - Defense moves to continue pretrial. Set for February 21st.

 

16CF155 - Dunham, Toby A - PreTrial - Defendant fails to appear. Had a previous FTA with a notice to appear get returned to the court. Defense has had no contact with defendant. Defense asks for opportunity to call probation office in Macon County to attempt to contact defendant. Set for January 27th for counsel only status.

 

16CF111 - Durbin, Brian J - PreTrial - Defense fails to appear. State asks for a new warrant. Seeks bond in the amount of $15,000. FTA warrant granted.

 

16CF229 - Ferguson, Brian K - PreTrial - Defense has been examined to see if he was competent to stand trial, but has not received the report on the evaluation. Defense moves to continue pretrial. Set for further pretrial February 2nd. State should also have an offer ready as soon as they see the evaluation.

 

16CF117 - Hedrick, Mark A - PreTrial - State has made an offer to defendant. Defense isn’t currently in a position to accept. Set for further PreTrail January 23rd.

 

16CF073 - Krouse, Jacob C - Plea - State has spoken with probation, and defense is in compliance with probation. State requests a notice to appear. Set for February 21st.

 

16CF198 - Lawrence, Jarred L - Status - Defense has spoken with counselor of defendant who confirmed that defendant is in treatment on a furlough. Continued to February 21st.

 

16CF165 - Reiss, Chad M - Final PreTrial - State made an offer to defendant which is acceptable to defendant. Defendant does have some loose ends to tie up first. Case set for plea hearing on January 24th.


16CF044 - Sklenka, Brett M - PreTrial - Defense has filed motion of disclosure of confidential sources. State has made an offer however and defense would like time to go over that. Pretrial continued to January 26th.

16CF036 - Droke, Harvey G - Status - Defense would like to continue for a March setting. Set for status on March 23rd.

 

16CF234 - Humphrey, Laura A - PreTrial - Negotiated disposition reached. Defendant would be entered into an offender initiative program. Guilty plea would be entered at this time.

 

17CF004 - McCaughn, Samantha L - PreTrial - Defense has coordinated treatment. Defendant sent to Bloomington and kept longer than just the detox, and have entered her into treatment.

16CF119 - Purcell, Kevin M - Plea - Negotiated plea reached for all matters. Defendant would be pleading guilty as charged to count 1 in 16CF219. Will receive 18 years in the Illinois DOC. Will get credit for 85 days served. Defendant must serve 75% sentence, with no eligible probation. Other cases would be dismissed. Law enforcement has been notified and are agreeable to terms of the plea.

 

16CF042 - Stivers, Robert A - Subpoenaed Records - On December 19th an order was made to require DCFS to provide both sides with unredacted records on the case. State has filed motion to vacate. Jason Adams with the Illinois Attorney General’s office present representing DCFS. Court received on January 17th sealed envelope from springfield clinic opened in court. Documents turned over to defense attorney, with copies provided to state as well. Defense has spoken with state and believes there cannot be a resolution to the motion to vacate. State prepared to provide records to the case. State produced records during discovery that they had received with redacted information. DCFS holds position that they would submit unredacted records with a request for redaction. Neither party ready to discuss redacted records. Defense wants information on witnesses that the state might have but defense doesn’t. Set for further argument on DCFS motion to vacate on February 6th at 11.

16CF087 - Beck, Micah Dawn - PreTrial - Move to continue for a week to come to a resolution on the felony matter. Set for January 23rd.

 

17CF008 - Bright, Justin M - First Appearance - Charges read to defendant. Defendant asked to speak with state. Case continued until Wednesday.

 

16CF095 - Burkey, Del L Jr - PreTrial - Defense requests 402 conference prior to jury trial. Matter continued for 402 conference on January 24th.

 

17CF005 - Campbell, Kody E - Bail Reduction Motion - Defense moves to continue to the motion. Defendant recently out of detox and would like to seek a furlough order for treatment once a bed is available. Order granted, and case set for status February 3rd.

 

16CF009 - Ellis, Keri C - PreTrial - Mental health court referral made by defense. Defendant reports that she’s been reporting to probation. Judge says he’s received an e-mail saying she hasn’t been. Email was reviewed. Court continues case for a week so defendant can complete all evals that defendant needs to complete. Continued until January 23rd.

 

16CF210 - Gazdowicz, Clarence R - PreTrial - Defense in process of completing parenting classes. Will be done February first. State waiting to tender an offer to defense pending completion of the class. Set for pretrial February 7th. Jury trial continued.

 

16CF158 - Merritt, John D - PreTrial - State has indicated progress made on a mental health court evaluation, stating that it has been completed. Evaluation needs to be reviewed however. Defense asks for continuance. Set for January 24th.


16CF089 - Steele, Donnie S - PreTrial - Defense asks for final pretrial date, and will have a decision on whether or not the defense will accept the offer given to them by the state. State agrees to a final pretrial, and will keep their offer open until Friday at 3pm. Set for final pretrial for January 24th.

16CF218 - Sizemore, Jamie D - Prelim Hearing - Plea agreement has been reached. Guilty plea in misdemeanour charge. Other charge dropped. Defendant will serve 4 days in the Christian County jail. Money still owed. Set for payment review in March 22nd.

No family outside of Christian County and doesn’t pose a flight risk. Argues that the earlier the court can help the defendant with treatment, the better. Asks to be released if and when treatment becomes available. State wishes to hold sentencing hearing before any other matters are discussed. Motion denied due to tight timeframe until sentencing. Says matters will be addressed at sentencing. Set for January 26th.
