Christian County Court Cases 7/31/23

The following cases were heard on July 31st, 2023:

 

Jessimaya Baird: Defendant fails to appear. Notice to appear to issue for 8/31/23 at 10 a.m.

 

Matthew Cunningham: Defendant present with Public Defender and State's Attorney present. By agreement, and on the petition to revoke scheduled for 9/21/23 at 11 a.m. in person. Defendant admonished re-hearing in his absence.

 

Cody Fringer: Defendant present pro se and State's Attorney present. Defendant still advised he did evaluation and no counseling was recommended. By agreement, case continued for first appearance to 9/12/23 at 10 a.m. in person.

 

Starla Hostetler: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing set for 8/2/23 at 9 a.m. Parties have agreed to furlough but are waiting for treatment.

 

Charlene Ray: Parties present by counsel. Defendant currently in treatment on furlough. By agreement, case continued for status hearing on 9/15/23 at 10 a.m.

 

Jessica Ruiz: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $25,000 over objection of Public Defender.

 

Richard Shivers: Parties by counsel. No action taken on motion to quash today as Defendant's whereabouts are unknown. Defendant now in custody on warrant. By agreement, Defendant ordered released on a $25,000 OR bond so he can obtain metal health treatment. Pretrial hearing scheduled for 8/25/23 at 10 a.m.

 

Issac Vargas: Defendant present with Assistant Public Defender Grigsby and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds no probable cause as to Count 1. Count 1 is dismissed, and tha tState is granted leave to refile Count 1 as a midemeanor. Arraingment scheduled for 8/31/23 at 10 a.m.

Chase Gatons: State's Attorney present; Defendant present by Attorney. Reset for 402 Conference 8/10/23 at 8:45 a.m.

 

Bradley Gobert: Stat'e Attorney present; Defendant in Custody. Defendant admonished on penalties, right and charges; Attorney Grigsby apointed for bail hearing. PC proffered; bond set at $25,000 (10% to apply). No contact wiht alleged victim or her residence whether bail or not. Michael Beaty: Defendant present with Public Defender and State's Attorney present. Defendant waives arraignment, pleads not guilty, and demands trial by jury. By agreement, final pretrial hearing scheduled for 9/19/23 at 1:15 p.m. Jury trial scheduled for 10/2/23 at 8:30 a.m.. Both hearings are in person. Joshua Hill: Defendant present with counsel and State's Attorney present. Austin Mayes: Defendant present with Public Defender in custody of the Sheriff and State's Attorney present. PD files petition for Rule to Show Cause which is verified. Rule to Show Cause to issue with hearing set 8/11/23 at 10 a.m. DHS has advised CCSo they anticipate taking custody of Defendant around 8/1/23.

 

Amiee Miller: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 8/11/23 at 10 a.m.

 

Gilbert Neal: Defendant present pro se and SP Havera present. Defendant recently beca,e employed but is without sufficient resources to hire counsel today. PD appointed subject to reimbursement. First appearance with counsel 8/15/23 at 10 a.m.

James Eiskant: Defendant present in custody with Assistant Public Defender Grigsby, who is appointed to represent Defendant and State's Attorney present. Defendant admonished re charges and possible penalties. Proffer made. Probable cause found. Bond hearing conducted. Cash bond found appropriate in the amount of $500,000, subject to the terms of the pretrial release order. See written order. PD appointed to represent Defendant. Devon Gatons: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8/25/23 at 10 a.m. Case called for hearing on motion for recognizance bond. Arguments heard. Motion granted for reasons stated on record. Defendant ordered release from custody on a $50,000 recognizance bond subject to the terms of the second amended pretrial release order and the home detention order.

 

Clint Hadden: Defendant fails to appear. PD Herkert and State's Attorney present. Warrant to issue. Bond set at $50,000 over objection of PD Herkert. Bond forfeiture notice to issue, returnable on 9/7/23 at 10 a.m. Defendant appears late and warrant quashed and bond forfeiture proceeding is dismissed. Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of DWLR (Count II). Count I dismissed per plea. By agreement, Defendant sentenced to one year in the Illinois Department of corrections followed by up to one year of mandatory supervised release. Balance to collections.

 

Debbie Horn: Parties present by counsel. Treatment status scheduled for 8/25/23 at 10 a.m.

 

Ace Kobe: Parties present by counsel. By agreement, first appearance reset to 8/25/23 at 10 a.m., as Defendant is going to treatment today.

Sentencing hearing scheduled for in person hearing on 8/25/23 at 1:15 p.m. Probation department ordered to update the PSI and privde copies to counsel and the Court. Case called for hearing on Defendant's Motion for Bond Reduction. Defendant sworn and testifies. Arguments heard. Motion denied for reasons stated on the record.

 

Nicholas Cox: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing contined to 8/28/23 at 10 a.m. State to make offer.

 

Matthew Harden: Defendant present by Attorney Brown and State's Attorney. By agreement,, petition to expunge granted. See written order.

 

Brittany Hill: Defendant present with counsel and State's Attorney present. Case called for hearing on Defendant's motion for appointment of special prosecutor. Arguments heard. Motion granted for reasons stated on the record. SAAP appointed as special prosecutor. Pretrial hearing scheduled for 8/15/23 at 10 a.m.

 

Ashley Layton: Defendant present with Public Defender and State's Attorney present. Pretrial hearing contined to 8/28/23 at 10 a.m. State has made plea offer and answered discovery. Defendant unable to meet with counsel after last court date but will schedule appointment today.

 

Jason Leach: Defendant present in person with PD Grigsby and State's Attorney present. Parties stipulate to the admission of Dr. Killian's report. The Court finds Defendant is not fit to stand trial but is likely to be restored to fitness with outpatient treatment to be done based upon a referral from DHS will be facilitated by the Public defender's office. Status on fitness restoration scheduled for 10/10/23 at 10 a.m. Written order to follow.

 

Drakeem Manning: Defendant present with Public Defender and State's Attorney present. For reasons stated on the record, motion to modify furlough to allow defendant to engage in the FGC extended stay program granted, subject to defendant's compliance with any program terms of FGC. Defendant ordered to return to the jail upon leaving that program for any reason. Pretrial hearing scheduled for 8/29/23 at 10 a.m. 7/21/23 hearing vacated. Count III dismissed on motion of the State for reasons stated on the record.
