Christian County Court Cases 8/30/16

These are the results of the following court cases heard on Tuesday, August 30th at the Christian County Courthouse.16CF012 - Banning, Jacob O - Prelim Hearing

 

15CF238 - Benavides, Anthony D - Plea - State makes formal motion to withdraw PTR with one of the cases, and will dismiss another charge, with bond being transferred to another charge. Defendant would plead guilty to count 4, count 1 would be dismissed, and will be sentenced to two years of probation. Also sentenced to 266 days in the Christian County Jail with credit for time served. Court accepted terms of the plea. A payment plan of $50 a month established.

 

16CF156 - Denton, Casey D - Prelim Hearing - State calls officer Jason Cole from the Pana Police Department to the stand. Testified that he responded to a domestic disturbance. Said he observed a female with injures sitting in a desk chair in the living room. Said that she was shaken up and that her face was swollen and bloody. Woman testified that defendant had caused her injuries. Officer Cole also noted a blood trail from the back bedroom into the living room. Said there were other adults at the residence who said that defendant had struck the woman. Defendant had left residence, and an ambulance was called for the woman. The woman also gave a written statement. Had said that defendant had used a hammer to strike her shoulder. State asked for the court to find probable cause based on the officer’s testimony. Defense asked court to not find probable cause saying how there is no testimony that indicates the presence of great bodily harm. State reminded court that there was a testimony of a trail of blood from the bedroom into the living room, indicating great bodily harm. Court ruled that there is no definition between the difference between bodily and great bodily harm. Court finds that there is some evidence for probable cause, and ruled that there is probably cause. Defense waives formal arraignment, enters a plea of not guilty, and requests trial by jury. Jury trial set for October 11th, with pretrial for September 20th.

 

16CF183 - Fisher, Carl J - Motion to Reduce Bail - Defense testified that he’s never been convicted of a felony before, and isn’t currently on probation or parole. Stated that if he was released on bond that he would live with his mom, and that his family might be able to come up with $500 for bond, and asked bond be reduced to $5000. State said they feel bond is set appropriately, and brought up a previous failure to appear by the defendant. Court denies motion to reduce bond. Prelim hearing set for September 20th.

 

16CF188 - Lecocq, Tyler P - Motion to Reduce Bail - Defendant testified that if he were to make bond he’d reside with family in Christian County. Stated that the last time he was in the Illinios DOC was in 2005. Stated that there has never been a failure to appear with him. Asked for bond to be reduced to $10,000. Defense argues that although there is a criminal record, the time was served and since then, there has been no other convictions. All other arrests have resulted in dismissals. Defense argues he’s not a flight risk. State said there were no new details that weren’t heard when probable cause was found. Did state that items have been recovered in his possession that had previously reported missing. Said that the state is in the process of connecting the dots between these items and possible thefts. Court denies motion to reduce bond, noting the previous criminal history and extent of evidence presented.

 

16CF089 - Steele, Donnie S - PreTrial - State requested a change of jury trial. Jury trial changed to October 11th. Defense asked for further pre-trial on September 20th. Pretrial set for that date.


16CF033 - Van Houtin, Jerry F - Motion to Reduce Bail - Defense moved to continue motion. Stated how defendant is currently homeless and wouldn’t have anywhere to go. Bond motion continued generally without a date set.

16CF186 - Barger, Brendan T - Motion to Reduce Bail - Matter continued until September 9th.

 

16CF187 - Beaty, Michael W - Motion to Reduce Bail - Defense needs to see if defendant is going to be picked up by the department of corrections for a DOC warrant. Bond motion continued until September 9th.

The following court cases were heard on Monday, August 22nd at the Christian County Courthouse.

 

16CF143 - Williams, Marciano - PreTrial - Defendant pleads guilty.


16CF187 - Michael W. Beaty - First Appearance - Defendant didn’t respond to questions at first, and was warned of using inappropriate language once he did. Defendant later ignored warning, and continued to use inappropriate language. Was sentenced to criminal contempt of court and ordered to serve 7 days in jail. State began reading probable cause when defendant continued to speak out of order. Judge Paisley warned defendant that should he continue to speak out of order he would be removed from courthouse. Bond set at $50,000. Court appointed public defender. First appearance with counsel set for August 23rd.

Christian County Court Cases 8/19/16

The following court cases were heard on Friday, August 19th at the Christian County Courthouse.


 

16CF175 - Cunningham, Robert L - Appearance with Counsel - Defendant taken into DOC hold, and passed away while in custody. All charges dismissed.

 

15CF211 - Dickey, Cameron G - First Appearance - Defendant read charges. Appointed a public defender. First appearance with counsel September 15th.

 

16CF009 - Ellis, Keri C - PreTrial - Serving a 30 day sentence in Macon County Jail. Reset for pretrial September 8th.


15CF072 - Millburg, Sherry L - Appearance with Counsel - Defendant denies allegations of PTR, and asks for pretrial. Pretrial set for November 17th.

13CF200 - Gatton, Danielle M - PTR/PreTrial - Defendant complying with conditions of her probation. Status hearing set for October 20th.

 

16CF179 - Sarver, Dwain E - Appearance With Counsel - Motion for bond reduction filed. Defendant testified that he isn’t currently employed. Stated that he could get back to work if he was released. Can not currently come up with the current bond amount. Said how he’s only missed court once due to a miscommunication. Asked for a bond of $5,000. Defense argued that defendant has half of the current amount of bond and is willing to comply with all conditions for bond. State argued that recent charges happened while defendant was out on bond, and opposed any bond reduction. Court said how defendant had previously had bond reduced only to have new charges acquired by defendant. Motion for bond reduction denied. Preliminary hearing set for September 1st.

Christian County Court Cases 8/16/16

These are the results of the following court cases heard on 08/15/2016 at The Christian County Courthouse.

 

16CF181 - Pugsley, Cody M - Motion to reduce bail - Defense argued that state must show probable cause beyond a reasonable doubt that the act of battery was done without justifiable reason. Stated how defendant did not initiate the physical contact with the victim, and that the victim was the initial aggressor. State argued that the defense sounded more like an argument to dismiss, and said how probable cause has already been found and bond set. Said how victim was sent from Taylorville Memorial Hospital to the trauma center in Springfield, and how that helps show that excessive force was used. Court denied the motion stating how the defendant has other pending cases failure to appears.

 

16CF067 - Redfern, Emily R - Negotiated Plea - Defendant pleads guilty as charged to 1st charge. Will be placed on 2 years probation, and sentenced to Christian County correctional facility for 244 days with credit for 122 days served. Drug counseling must be completed before being released. Defendant will have the felony kept off her record if she complies with all demands in the plea.


16CF166 - Reiss, Stephen L. - Motion to Reduce Bail - Defense testified on the motion. Stated that should he be released he would stay in Christian County. Said how he currently cannot raise enough funds to post bond. Has made all previous court dates and never had a warrant for failure to appear. Asked for bond to be reduced to $10,000. Testified that he doesn’t have a history of violence. Defense argued that the charge doesn’t involve violence, and how there is no history of violence with the defendant. Defense also stated that the case against the defendant is a weak one at best due to lack of direct evidence linking defendant to the charge. State argued how they plan to file an additional charge against defendant, and that probable cause was found in the case. Matter continued until August 25th due to State’s plan to file additional charges.

These are the results of the following court cases heard on 08/15/2016 at The Christian County Courthouse.

 

16CF091 - Carroll, Dylan L - Preliminary Hearing - State has filed a resisting a peace officer charge. Made a motion to nolly count 1. Defense requested matter to be set within 45-60 days. Court accepted notion to nolly count 1. Next court date October 13th.

 

16CF097 - Harris, Audra L - Pre-Trial - Defense and state reach negotiated plea. Defendant to report to probation to set up 40 hours of community service. Defendant would write a written apology letter to arresting officer, and will pay $100 per month starting next month. State requests payment review after several months. Payment review set for November 30th.


16CF067 - Redfern, Emily R - Pre-Trial - Defense has lab results back. Will be prepared to present a negotiated plea tomorrow. Pre-Trial with possible plea set for August 16th.

These are the results of the following court cases heard on 08/09/2016 at The Christian County Courthouse.

 

16CF156 - Denton, Casey D - Motion to Reduce Bail - Defendant testified before the court. Said he has no means to pay bond, and was requesting a recognizance bond. Defense argued that the defendant has no felony convictions and has lived in Christian County most of his adult life. State opposed a release on recognizance stating how it’s a class two domestic battery, and how defendant is uncertain of residence, and could be a flight risk. Matter set for preliminary hearing on August 30th.

 

16CF081 - Page, Kody K - Status Hearing - Motion for drug court filed. Next status hearing September 16th.

14CF073-15CF193-15CF137 Rebecca Bayless. Pre trial hearing for Obstruction of Justice, Contributing to the Criminal Delinquency of a Minor and a Bad Check. Status hearing set for September 22nd at 10AM.

 

14CF154 Joshua Boyle. Pre trial hearing for Aggravated Fleeing, Driving on a Suspended/Revoked License and Obstruction of Justice. Status hearing for defendant's request to revoke probation set for September 27th at 10AM.

 

15CF185 Aaron Fitzgerald. Pre trial hearing for Possession Amount of a Controlled Substance and Possession of Drug Paraphernalia. It was the 2nd failure to appear according to defendant's representation. Representation stated that the defendant was released on bond in the past to go serve time at Shelby County Detention center. Clerk’s office did not receive notice to send an order to appear to defendant. State’s position was to send another notice to appear on august 26th at 10AM.

 

16CF059 Michael Loflin. Pre trial for Criminal Sexual Assault. Motions are pending since state had just met with victim and reviewing the case. Request for a speedy trial by the defendant is on file. Defendant's request for a continuance was granted. Pre trial set for September 1st at 10AM pre trial set.

 

16CF128 Devon Newman. Preliminary hearing for Possession of a Controlled Substance, Fleeing/Attempting to Elude Officer and Resisting Arrest. Waived right to a preliminary hearing and formal arraignment in writing. Plead not guilty. Jury trial request. Pre trial to determine case is set for September 22nd at 10AM.

 

16CF106 Vincent Page. Status hearing for a charge of Meth Manufacturing. Representation for the Defendant stated that they are awaiting results of a psychological evaluation report. A request to move the jury trial to august 25th at 10am was granted.


16CM085 McKenzie Coleman. Pre trial for the charge of Resisting a Peace Officer. Representation for the Defendant asked the court to hand down a sentence of 8 days with credit for 4 days already served. A payment review hearing was set for October 19th at 9am. Court issued a $200 fine plus court costs and asked for a plea at the next hearing.

16CF161 Wade Bottoms, Violent sex offender registration pretrial - Defense and state working on plea deal. August 12th for further pre-trial.


16CF067 Emily Redfern possession of meth, pre trial - Defense awaiting status of crime lab. State said they will ask about the results for defendant when they call the crime lab today. August 15th for further pre-trial.

 

16CF165 Chad Reiss, meth manufacturing, preliminary hearing - State called witness with Pana Police Department and the Central Illinois Enforcement Group to stand. Stated that he had information who had showed that there was an active meth lab at the house in question. Said how there was a search warrant obtained with the information gathered. Said multiple items associated with met manufacturing found at house. Also stated that meth had been purchased from Chad Reiss. Stated defendant had stated “You got me” to officers. Substance obtained at residence field tested positive for meth. Said there was an odor and fog in the house consistent with meth manufacturing. State asked court to find probable cause due to testimony from the officer. Defense stated that there must be some evidence showing that a crime has been committed, and that the evidence presented so far doesn’t indicate that the crime charged was justified. Said how just because there was something going on in their home, that doesn’t mean the defendants participated in it. State recalled the officer to the stand. Asked if the confidential informant who had entered the house wired with video had captured anything to indicated that the defendants were participating in the manufacture of meth. Stated Chad Reiss shook a bottle on video. Court found probable cause for both Chad and Steven Reiss to bring the matter to jury trial. Defense requested jury trial October 11th for jury trial. September 20th for further pre-trial.

16CF176 - Doud, Destiny A - First Appearance - Agreement for bond reduction to $30,000. Conditions of no contact with Kevin Purcell directly or indirectly to apply. Judge Paisley added condition of any known drug users to the conditions of bond as well. Matter set for preliminary hearing on September 1st.

 

16CF116 - Rentfro, Dylan R - PreTrial - Negotiated plea reached. Defendant pleads guilty and sentenced to 3 years in the Illinois Department of Corrections with 2 years of mandatory supervised released.

For The Record 8/4/16

16CF142 - Tristan Dilley - PreTrial - Defendant pleads guilty. Sentenced to 6 years in department of corrections and two years of mandatory supervised release. Judge did mark that the crimes were committed due to a drug addiction to help get defendant access to treatment.
