16CF089 - Steele, Donnie S - PreTrial - Mother of defendant’s infant child filed motion to allow visitation for defendant. Defendant wishes to continue formal trial date. State has no objection. Continued for jury trial on December 5th. Next pretrial setting set for November 22nd. State objects to motion to modify bond conditions. Mother of child who filed motion said that she wished for her daughter to see her dad in jail. Defense said how he’s anxious to see his child. Child and mother present when matter occurred but are not victims in case. Stated how the reason the parties are protected are due to the child being thrown onto a couch during the incident. Court modifies pretrial release to allow the mother and child to see defendant in jail, but places court order to not allow parties to discuss case during visits. December 5th date for Jury trial and November 22nd date for further pretrial.


16CF108 - Wiseman, Christina M - PreTrial - State has been gathering information to make an offer, and is close to making an offer. Asked for further pretrial date. Set for November 3rd.

16CF188 - LeCocq, Tyler P - Prelim Hearing - Officer Scott Woods of the Christian County Sheriff’s Office testified on behalf of the state. Said he responded to a call about a break in. Officer Woods arrived on scene and spoke with the owners of the property and had learned a motorcycle and 4 wheeler missing from a shed. Officers who responded noticed screws removed from the siding of the shed where entry had been made. Also found a hammer and mask in proximity to where entry had been made. Officers also found fingerprints on the siding of the shed. Those fingerprints were identified to be those of defendant. Officer Woods said the 4 wheeler was recovered in Springfield. Said during the investigation a tracker had been placed in defendant’s vehicle, where he had stopped at a shop where the owner later revealed the defendant had sold him the 4 wheeler. The serial number matched the one stolen on that 4 wheeler. Woods also testified that when the defendant was arrested, several other stolen items were found in defendant’s vehicle, and how several of those items have been traced back to other items reported stolen. State argued that there is definitive evidence pointing to defendant committing the crime, and asked that the court find probable cause. Defense waives formal arraignment and enters plea of not guilty. Court finds probable cause. Jury Trial set for November 7th. Further pretrial for October 17th.

 

16CF181 - Pugsley, Cody M - Motion to Reduce Bail - Defense has agreed with the state to continue the motion until next week when Judge Paisley returns. Reset for September 19th.


16CF089 - Steele, Donnie S - Motion Hearing - Request by victim’s daughter to modify the bond conditions to allow her child to see the defendant in jail. Court had issues allowing it due to a lack of counsel present for defense. Motion continued until September 20th.

Christian County Court Cases 9/13/2016

These are the results of the following court cases heard on 09/13/2016 at The Christian County Courthouse.

 

16CV056 - William Kremitzki - First Appearance - Conservation Charge - Defendant persisted in plea of not guilty. Defendent requests bench trial. Trial to be held on October 25th at 1:15pm.

 

16CF154 - Mallory N DeClerck - Petition to Modify Bond- Posession of a Controlled Substance - State filed amended petition to modify bond. Defendant was ordered to submit to drug testing by the State where DeClerck tested positive for methamphetamine. Bond was previously set at $10,000. State requested bond be raised to $15,000. The Court approve but chose to give 14 days to serve and after said time, the bond would lower back to $10,000.

 

12CF137 - Christopher Hardwood - Pre Trial - Arson/Residential Arson/Aggravated Arson - Post conviction hearing set for October 11th, at 10AM. Defendant asked for additional 10 days for amended post conviction petition.

 

16CM194 - David L. Haubner - First Appearance - Child Endangerment - Allowing child to smoke and become intoxicated by synthetic compounds. The State is not waiving jail time at this time. Defendant chose to have the public defender represent. Set to appear next on October 14th, at 10AM.

 

16CF180 - Joshua Lynch - Bond Date - Theft - Defendant present without counsel. Charged with class 4 felony retail theft. State says on or about July 29th, Defendant took possession of merchandise from CVS of less than $300 worth. The court explained possible penalties and jail time to Defendant. Defendant chose to speak with state and at that time decide on counsel representation. New court appearance set for October 7th, at 10AM.


16CM195 - Sean M. Rush - First Appearance - Child Endangerment - Allowing child to smoke and become intoxicated by synthetic compounds. The defendant is represented by the public defender, Dennis Atteberry to represent. Defendant set to appear on this case matter as well as others on September 22nd, at 10AM.

11CF183 - Suggs, Nicholas L - First Appearance - Court had issued warrant for defendant’s arrest with monetary bond. Sangamon County Sheriff’s office had arrested Suggs and released him on a recognizance bond. Court issues a notice to appear for October 11th.


15CF009 - Swinburne, Kristopher M - PreTrial - Defense has switched probation offices, and has been visiting counseling. Hasn’t had contact with new probation officer yet. Ordered to report to probation today to get records up to date. Defense requested matter to be set for further pretrial.

14CF112 - Alex M. Collingwood - Pre-trial - Defendant has successfully completed in-patient treatment and completed his payment order. State requested further pretrial to further monitor the status of the case. Set for November 3rd.

 

16CF111 - Brian J. Durbin - Appearance with counsel - Defense no longer wants his attorney to represent him and wanted a public defender. State had no objection to the removal of counsel.

 

16CF106 - Vincent B. Page - Status hearing - Defence has a drug court anaylisis, state wants to know if he’s a candidate for mental health court. Further hearing set for September 15th.

 

16CF116 - Stephen L. Reiss - Motion/Reduce Bail - Defense said that the evidence that the state has presented is problematic at best, and asked for bond to be reduced to $10,000. State objected to the motion due to the serious nature of the charge and the evidence presented so far in the case. Defense argued that none of the previous evidence shows the defendant actually participating in the crime. Only being present while the crime was being committed. Court denied the motion based on the request of $10,000. Said he would reconsider if defense able to post a higher bond. Same dates set for further pretrial and jury trial.

 

14CF036 - Alexander B. Shanks - Status Hearing - Defense has filed motion to seek additional credit for time served. Had previously pleaded guilty and was given 68 days credit. State unsure what the basis was of the request. Defense said he would received 109 days credit for his sentence for the total days served for both. Court said that the DOC was calculating the days credit served correctly. Previous defense attorney said that the defense was correct and that they had had the discussion regarding the days credited served. State wanted to look at the transcripts for the plea agreement to find out what exactly was heard. Next hearing set for October 23rd. Previous defense attorney assigned to represent defense.

15CF165 - Robert A. Stivers - Pre-trial - State hasn’t had a chance to review motion filed by defense and wanted more time to review it. Defense informed court that the medical examiner involved with the investigation of the case would be available to testify on findings. Court is still deciding if additional charges will be filed. Defense said that they cannot continue a defense without expert testimony from medical expert. Autopsy in the case has been received and details will be reviewed within the next week. Further pretrial set for further pretrial on September 15th.

 

16CF042 - Robert A. Stivers - Pre-trial - State hasn’t had a chance to review motion filed by defense and wanted more time to review it. Defense informed court that the medical examiner involved with the investigation of the case would be available to testify on findings. Court is still deciding if additional charges will be filed. Defense said that they cannot continue a defense without expert testimony from medical expert. Autopsy in the case has been received and details will be reviewed within the next week. 16CF096 - Luke W. Waddington - Pre-trial - Defense and state working out a plea deal. Date set for possible plea on November 14th.


16CF197 - Lonnie R. Wilkerson - Motion/Reduce Bail - Defense testified that he moved from Texas to Illinois to live with his brother and eventually return to college. Said he has no prior felonies and has never missed court. Said if he was let out he would stay in one place and attend all court dates. State asked if he has any other aliases. Defense said he has a nickname but doesn’t commonly use it. Defense argued that the defendant has no felony background and doesn’t have a means to post bond. State said that they do have a prior criminal record under the nickname Sylvester, including several theft charges. Defense asked for more time to sort out the details for the previous nickname. Set for September 15th.

Christian County Court Cases 9/6/16

These are the results of the following court cases heard on Tuesday, September 6th at the Christian County Courthouse.

 

16CF189 - Budds, Keith E - Motion to Reduce Bail - Defendant testified that he has a fairly clean criminal record. Defense argued that he has no previous criminal record, and has spent his entire life in Pana. Said there is no indication to flee, nor would he fail to appear. Said he can’t post a $50,000 bond, but can post a $20,000 bond. State objected to bond reduction due to nature of offense. Motion denied. Court said $50,000 is a fairly low bond for the charge.

16CF196 - Hayes, Gary R Jr - Motion to Reduce Bail - Defendant testified that he is not employed at this time, and has no prior convictions either in Illinois nor in his previous residence in Texas. State questioned a previous charge in Texas. Defense argued that the Texas matter was a miscommunication and didn’t result in a conviction, so he has no previous convictions at this time, and asked for bond to be reduced to $5,000. State objected to bond reduction stating that they feel that bond is reasonably set. Motion denied. Court said bond was set reasonably. Preliminary hearing set for September 22nd.

 

13CF178 - Kee, Adam J - PreTrial - Defendant has a counseling appointment set for today. Court asked about an admission to PTR in March, yet defendant is just now seeking counseling. Court orders defendant to report to probation and sets a sentencing hearing for November 14th, with further pretrial on November 4th.

 

16CF064 - Merritt, Eric J - PreTrial - There was some confusion as to whether or not defendant has been drug tested with the probation department. Defendant says he has been several times, court only has record for once. Defendant also supposed to be on color system, and defendant informed court that he isn’t. Court called probation officer, who informed he wasn’t aware of the color. Matter will be set for status on the discrepancies on September 29th.

Defense asks for 48 hours to return before a FTA warrant is issued. State objected the delay of a warrant due to a new battery charge.
