Christian County Court Cases 11/30/23

The following cases were heard on November 30th, 2023:

 

Aaron Davis: Defendant present with Public Defender and State's Attorney present. State's attorney has conflict of interest and will seek the appointment of a special prosecutor. Pretrial 1/12/24 at 10 a.m.

 

Dustin Durbin: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/19/24 at 10 a.m.

 

Rocky Ford: Defendant present in person pro se and Assistant State's Attorney present. For reasons stated on the record, petition to revoke withdrawn and probation terminated. Balance previously forwarded to collections.

 

Melissa Foreman: Defendant present with counsel and Assistant State's Attorney
present. Parties present proposed plea agreement to amended, misdemeanor battery charge. Alleged victim present in the courtroom and objects. State indicates they have knowledge of some potentially exculpatory evidence but have not yet reviewed same with the alleged victim. Court will not accept the plea agreement today but requests that the alleged victim be given an opportunity to review the evidence mentioned in court today. Pretrial hearing scheduled for 12/21/23 at 10 a.m.

 

Jacob Melton: Defendant present by Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/25/24 at 10 a.m. Defendant's presence excused due to medical condition.

 

Michael Morrissey: Public Defender present, Assistant State's Attorney present. State provides probable cause; Court finds probable cause. Matter set for first appearance/detention hearing on 12/1/23 at 1 p.m.

 

Samantha Olivio: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/18/24 at 10 a.m. at 10 a.m. Parties have a possible hybrid plea agreements that would involve a consecutive sentence to treatment court. Defendant needs to complete all of the evaluations. Defendant ordered to immediately report to the probation department to determine what else needs to be done to complete the evaluation process.

 

Robert Scott: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 2/20/24 at 10 a.m.

 

Derik Steck: Defendant present in person and in custody with Conflict Public Defender Herkert and State's Attorney present. Case called for hearing on State's petition to deny pretrial release and preliminary hearing. Witnesses sworn and testify. Arguments heard. Court finds probable cause and that the State has met its burden of proof by clear and convincing evidence on the petition to deny pretrial release. Defendant ordered detained until trial for reasons stated on the record. See written order. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 1/11/24 at 10 a.m.

 

Brent Woodall: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 12/12/23 at 1:15 p.m. Jury trial scheduled for 1/2/24 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions by 12/8,23 to be heard at the final pretrial hearing. Trial in abstentia admonition given. Defendant admonished regarding the charges and possible penalties as to Count V. Parties are unclear whether the previous preliminary hearing was sufficient to encompass the allegations in the new count. Preliminary hearing as to count 5 scheduled for 12/11/23 at 10 a.m. Court reviewed continued detention order and finds that the reasons for detention still exist and the order shall continue. Defendant admonished regarding potential right to appeal.

Christian County Court Cases 11/29/23

The following cases were heard on November 29th, 2023:

 

Bobbie Abberley: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 12/4/23 at 10 a.m. in person.

 

David Crutcher: Defendant present in person in custody with Public Defender Senger; State's Attorney present. Case called for hearing on Defendant's motion to suppress his statement based upon lack of recording. State confesses the motion. Defendant's statement is suppressed. Pretrial hearing and hearing on the motion to remove monetary conditions of bail scheduled for hearing on 12/11/23 at 10 a.m.

 

Robin Jones: Defendant persent with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/8/24 at 10 a.m. Defendant currenlty in treatment.

 

Brandie Jordan: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/16/24 at 10 a.m.

 

Austin Mayes: Defendant present with PUblic Defender in custody of the Sheriff and State's Attorney present. Parties stipulate to admission of IDHS 90 days report. court find Defendatn has been restored to fitness. See written order. Hearing on the motion to remove monetary conditions of pretrial release scheduled for hearing on 12/1/23 at 10 a.m.

 

Anthony Pakovich: Defendant present in person and in custody on new charges with Public Defender Senger. Assistant Public Defender Grigsby is appointed to represent Defendant going forward. Defendant indicates he still may try to hire private counsel. Stat'e sAttorney present. Case called for hearing on petition to revoke pretrial release. Proffer made. Arguments heard; motion granted for reasons stated on the record. Defendant's pretrial release is revoked and he is ordered into the custody of the Sheriff pending trial. See written order. In person preliminary hearing scheduled for 12/15/23 at 10 a.m.

 

Ashley Pults: Defedant present in person and in custody with Assistant Public Defender Grigsby. Assistant States Attorney present. Case called for preliminary hearing and detention hearing. Officer is sworn in and testifies. Arguments heard; petition for dtention granted for reasons stated on teh record. See written order. Safe Passage is authorized to schreen the Defendant at the county jail for inpatient substance abuse treatment. The parties anticipate and agreed furlough order if a treatment is found. Defendant waives arraignment pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 1/18/24 at 10 a.m. Defendatn admonished regarding her appeal rights.

 

Jerry Riggs: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/15/23 at 10 a.m. Continued detention hearing conducted and Court finds continued detention warranted for reasons stated on the record. Defendant admonished regarding his right to appel. All other pending matters continue for pretrial to 12/15/23 at 10 a.m.

 

Larry Skinner: Defendant present in person and in custody with counsel and State's Attorney present. Case called for sentencing hearing. Arguments made regarding sentencing alternatives. Defendant declines to make a statement and allocution. for reasons stated on the record, Defendant is sentenced to 10 years in the Illinois Department of Corrections followed by 18 months of mandatory supervised release, to be served at the rate of 50%, with credit for 755 days previously served through today. Court declines to impose any financial obligations based up the Defendant's current financial situation and any fine imposed would be reduced to zero based upon pretrial incarceration credit.

 

Derik Steck: Defendant present in person and in custody with Public Defender Senger, who has a conflict of interest and cannot represent the Defendant for the initial appearance or detention hearing. Public Defender Herkert has been appointed to represent the Defendatn. State's Attorney present. first appearnce and detention hearing continued to 11/30/23 at 10 a.m. All other pending matters set for status on that date.

 

Alyxis Whitcomb: Defendant present with Public Defender and Sate's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause as to Counts I and III. No probale cause found as to Count II which is dismissed without prejudice. Defendatn waives arraignment, pleads not guilty and demands trial by jury. Final pretrial hearing scheduled for 1/23/24 at 1:15 p.m. Jury trial scheduled for 2/12/24 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before teh jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Dennis Wilcutt: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/7/23 at 10 a.m. For reasons stated on teh record, the Court finds continued detention necessary and that order shall remain in effect. Defendant admonished regarding possible right to appeal this order.

Christian County Court Cases 11/27/23

The following cases were heard on November 27th, 2023:

 

James Eiskant: Defendant present with Public Defender; pretrial set for 12/12/23 at 10 a.m.

 

Jacob Garrett: Defendant present with Public Defender Grigsby, State's Attorney present. Pretrial hearing held; Court finds probable cause; waives final arraignment and demands jury trial. Pretrial hearing set for 1/18/24 at 10 a.m.

 

Patricia Hornbuckle: Special Prosecutor Mathis for the People; Defendant present by Zoom in open court with Attorney Barrows. Parties still tendering discovery; matter reset for further pretrial only on 1/22/24 at 11 a.m. Pretrial hearing will be held by Zoom.

 

Jeffrey Jones: Defendant present in court, Assistant State's Attorney present. On motion hearing date, Court grants motion to use "Affirmative Defense" and admonishes Defendant that he is responsible for discovery to the State regarding witnesses for that defense. Exhaustive witness list to be tendered to State and Defendant by 12/11/23 at 10 a.m. Set for final pretrial/all motion hearing on 12/18/23 at 11 a.m.

 

Anthony Pakovich: Defendant present with Public Defender Grigsby, State's Attorney present. Proffers on petition; Court takes judicial notice of conditions of no contact as agreed to by Defendant in 23-OP-43. Pretrial release is revoked, hearing on mitigation set for 11/28/23 at 10 a.m. Public Defender appointed in both cases.

 

Ashley Pults: Defendant present in court with Public Defender Grigsby, Assistant State's Attorney present. Charges admonished, information read to Defendant in open court. Probable cause given and found; State seeks detention and gives Defense discovery just prior to eharing. Detention hearing is set for 11/28/23 at 10 a.m.

 

Thomas Sipes: Defendant present with Public Defender Senger, Special Prosecutor Havera present via Zoom. On motion to remove monetary conditions; motion is denied, but parties agree to release of Defendant on $10,000 or bond. Pretrial hearing set for 1/12/24 at 10 a.m.

 

Derik Steck: Defendant present in court with Public Defender Senger, State's Attorney present. Reset for pretrial on 11/28/23 at 10 a.mm. Court is conflicted and recuses.

 

Danny Taylor: Defendant present in court with Public Defender Senger, State's Attorney present. Probable cause previously found by Judge Paisley. State's Attorney proffers again for the Court. State not seeking detention, no contact iwth 519 W. Adams St. or the victim. Public Defender Grigsby appointed; pretrial hearing set for 1/26/23 at 10 a.m.

Defendant is extended term eligible, but pursuant to the partially negotiated plea, state agrees not to seek an extended term sentence. Defendant ordered to immediately report to the probation department. Probation department ordered to prepare pre-sentence investigation report and to facilitate a TASC evaluation which is also ordered by the Court. In person sentencing hearing scheduled for 2/22/24 at 1:15 p.m. Defendant admonished regarding sentencing hearing in his absence. Probation department ordered to file pre-sentence investigation report and provide copies to all counsel of record at least 14 days before the sentencing hearing.

Time chargeable to the Defendant. Parties have reached an agreement for an Illinois Department of Corrections sentence on two of the felony cases pending in Christian County. Defendant has pending charges in Shelby and Macon counties that the parties are trying to resolve with the global offer. Plea hearing scheduled for an in person hearing on 12/7/23 at 10 a.m. in person.

 

Troy Woods: Defendant present with Public Defender Senger in custody and in person. State's Attorney Present. Defendant pleads guilty after being fully admonished to Count I. Remaining counts dismissed pursuant to partially negotiated plea. Parties do not have an agreement as to a sentence. In person sentencing hearing scheduled for 1/18/24 at 1:15 p.m. Probation department ordered to prepare pre-sentence investigation report and to facilitate sex offender evaluation which is also ordered. State to file motion to revoke bond which will be scheduled for hearing on 12/12/23 at 10 a.m.

Christian County Court Cases 11/20/23

The following cases were heard on November 20th, 2023:

 

Steve Adkins: Defendant present pro se and Assistant State's Attorney present. Case dismissed on motion of the State at the request of the alleged victim. Bond to be refunded less Clerk's bond fee.

 

Nikolas Allen: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/19/24 at 10 a.m.

 

Dustin Cline: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/23/24 at 1:15 p.m.

 

Dayton Durbin: Defendant present in custody on warrant and State's Attorney present. Defendant makes request for the appointment of counsel which is denied without prejudice. The Court will reconsider that request if he is unable to hire private counsel and makes at least three attempts to do so. By agreement, Defendant ordered released from custody subject to the terms of the pretrial release order. First appearance with counsel scheduled for 1/11/24 at 10 a.m.

 

Brandon Emery: Defendant present in person and in custody with Public Defender on new charges and State's Attorney present. Defendant admonished regarding charges and possible penalties. Robert Gerk: Defendant present remotely pro se and Assistant State's Attorney present. Defendant advises he has completed counseling and will provide proof of same to the State. Defendant indicates he can resume the $150 per month payments starting 1/1/24. Review 1/18/24 at 10 a.m.

Christian County Court Cases 11/16/23

The following cases were heard on November 16th, 2023:

 

Derrick Covington: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/18/24 at 10 a.m. Public Defender appointed to represent Defendant in all pending matters.

 

Anthony Delgado: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of retail theft, a class 4, extended term felony. Judgment of conviction entered. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. By agreement, Defendant sentenced to two years in the Illinois Department of Corrections followed by six months of mandatory supervised release, with credit for 377 days served, to be served at the rate of 50%, and to be served concurrently with the sentence imposed in 21-CF-56 out of Moultrie County. Assessments waived pursuant to rule 404 certification. Balance is zero. See written orders. Warrant quashed.

 

Jahquel Pearsall: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/21/23 at 10 a.m.

The following cases were heard on November 14th, 2023:

 

Debbie Horn: Defendant present remotely in custody of the sheriff with Assistant Public defender Grigsby and State's Attorney present. Defendant makes an oral motion to remove monetary conditions of bail and the State confesses that motion. By agreement, Defendant ordered released from custody subject to the terms of the pretrial release order. Defendant to make a treatment court referral. Pretrial hearing scheduled for 11/14/23 at 10 a.m.

 

Tyrone Powyszynski: Defendant present with counsel and Asst. State's Attorney present. By agreement, pretrial hearing continued to 1/5/24 at 10 a.m. Defendant to try to hire private counsel.

Christian County Court Cases 11/13/23

The following cases were heard on November 13th, 2023:

Shawn Christian: Defendant presetn via Zoom with Attorney Finks; State's Attorney McWard present. Defendant arraingned and admonished of charges and penalties. Preliminary hearing and petition to detain set for 12/15/23 at 1 p.m.

 

Anthony Pakovich: Defendant present with Public Defender Grigsby and Assistant State's Attorney present. State does not seek to detain, but is seeking no contact and other conditions (see conditions of pretrial release order). Defendant indicates that he is going to hire a private attorney. Reset status on 1/16/24 at 10 a.m.

Christian County Court Cases 11/2/23

The following cases were heard on November 2nd, 2023:

 

Chay Anthony: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/19/23 at 9 a.m. State has answered discovery and made a plea offer. Defendant wishes to make a counter offer.

 

Joseph Auman: Defendant present in person and in custody with Conflict Public Defender Herkert and State's Attorney present. By agreement, Defendant ordered to answer motion for discovery within seven days. State believes it is standard all the discovery in its possession or control. State has made a plea offer. Negotiations are ongoing. Final pretrial and jury trial dates remain as scheduled.

 

Jeremy Cagle: Defendant fails to appear. Notice to appear to issue for 11/30/23 at 10 a.m. Parties anticipate a plea agreement at that time and Public Defender did not send notice for today's hearing.

 

Melissa Foreman: Defendant present with counsel and Asst. State's Attorney present. By agreement, Defendant's motion to continue pretrial and jury trial granted without objection. Time chargeable to the Defendant. Parties have reached a plea agreement. In person plea hearing 11/30/23 at 10 a.m.

 

Joshua Hawthorne: Defendant present with Attorney Calvert and State's Attorney present. Case called for hearing on Defendant's motion to strike the State's petition to revoke pretrial release. The State filed a petition for revocation and/or petition for sanctions pursuant to 725 ILCS 5/110-6. Defendant filed a motion to strike the State's motion. 725 ILCS 5/110-6 provides that if a defendant has been granted pretrial release "under this section" and violates any conditions of release, the State may file a petition to revoke pretrial release or for sanctions, depending on the charge and the alleged violation. Since defendant is in custody on a bond and has not "been released," defendant claims the State cannot seek revocation or sanctions. For reasons stated on the record, motion to strike granted. Pretrial hearing set for 11/17/23 at 10 a.m.

 

Karla Price: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 12/14/23 at 10 a.m. in person. Defendant has not yet waived preliminary hearing.

 

Jerry Riggs: Defendant present in person and in custody with Assistant Public Defender Grigsby, who is appointed to represent him by agreement. State's Attorney Present. Defendant admonished regarding charges and possible penalties. Proffer made. Probable cause found for the arrest and detention of the defendant. State does not seek detention. Conditions of release hearing conducted and order entered for reasons stated on the record. See written order. In person preliminary scheduled for 11/28/23 at 10 a.m. PD Senger will represent Defendant at all future hearings.

 

Aubrey Smith: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/14/23 at 10 a.m. State to make plea offer.

 

Dennis Wilcutt: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 11/28/23 at 10 a.m. For reasons stated on the record, the Court finds continued detention necessary and that order shall remain in effect. Defendant admonished regarding possible right to appeal this order.
