Christian County Court Cases 7/20/23

The following cases were heard on July 20th, 2023:

 

Tiffany Burke: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 8/3/23 at 10 a.m.

 

Brianna Caldwell: Defendant present with counsel and State's Attorney present. Defendant admits the allegations in the Petition to Revoke. Parties trying to reach agreed sentence. Status on sentencing scheduled for 8/11/23 at 10 a.m.

 

Dustin Durbin: Defendant present with Public Defender and State's Attorney present. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 9/11/23 at 10 a.m. State to make offer today.

 

James Eiskant: Defendant present in custody with Assistant Public Defender Grigsby, who is appointed to represent Defendant and State's Attorney present. Defendant admonished re charges and possible penalties. Proffer made. Probable cause found. Bond hearing conducted. Cash bond found appropriate in the amount of $500,000, subject to the terms of the pretrial release order. See written order. PD appointed to represent Defendant. Preliminary hearing scheduled for 8/14/23 at 10 a.m.

 

Devon Gatons: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8/25/23 at 10 a.m. Case called for hearing on motion for recognizance bond. Arguments heard. Motion granted for reasons stated on record. Defendant ordered release from custody on a $50,000 recognizance bond subject to the terms of the second amended pretrial release order and the home detention order.

 

Clint Hadden: Defendant fails to appear. PD Herkert and State's Attorney present. Warrant to issue. Bond set at $50,000 over objection of PD Herkert. Bond forfeiture notice to issue, returnable on 9/7/23 at 10 a.m. Defendant appears late and warrant quashed and bond forfeiture proceeding is dismissed. Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of DWLR (Count II). Count I dismissed per plea. By agreement, Defendant sentenced to one year in the Illinois Department of corrections followed by up to one year of mandatory supervised release. Balance to collections.

 

Debbie Horn: Parties present by counsel. Treatment status scheduled for 8/25/23 at 10 a.m.

 

Ace Kobe: Parties present by counsel. By agreement, first appearance reset to 8/25/23 at 10 a.m., as Defendant is going to treatment today.

 

Charles Lair: Defendant present remotely with Assistant Public Defender Grigsby and State's Attorney present. Case called for hearing on motion for furlough. Arguments heard. Motion denied for reasons stated on the record.

 

Michael Loflin: Defendant present remotely with PD Herkert and State's Attorney present. Bassed upon violation report filed today, further sentencing hearing scheduled for in person hearing on 9/21/23 at 1:15 p.m. Probation department ordered to update the PSI. Defendant admonished re sentencing hearing in his absence. Defendant ordered to contact probation department.

 

Alisha Manion: Parties by counsel. PTR withdrawn. Balance to collections.

 

Christopher Mills: Defendant present Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8/31/23 at 10 a.m. State has not yet made offer but will do so today.

 

Cynthia Temmen: Defendant present with counsel and State's Attorney present. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 9/21/23 at 10 a.m.

 

Nathan Wiseman: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of Unlawful possession of a controlled substance. No judgment of conviction entered. By
agreement, Defendant sentenced to two years of 1st offender probation, four days in the county jail with credit for two days served, and he is ordered ro pay the fine and assessments as set forth in the financial sentencing order. See written orders.
