Christian County Court Cases 7/25/23

The following cases were heard on July 25th, 2023:

 

Michael Beaty: Defendant present with Public Defender and State's Attorney present. Defendant waives arraignment, pleads not guilty, and demands trial by jury. By agreement, final pretrial hearing scheduled for 9/19/23 at 1:15 p.m. Jury trial scheduled for 10/2/23 at 8:30 a.m.. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given. Writ continued.

 

Kyla Brown: Defendant present in person with counsel and State's Attorney present. By agreement, sentencing hearing scheduled for in person hearing 9/22/23 at 1:15 p.m. Defendant admonished re
sentencing in admonition.

 

Jerald Buerk: Defendant present with Public Defender and State's Attorney present. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 9/19/23 at 10 a.m. State has answered discovery and made plea offer.

 

Jeremy Cagle: Warrant returned showing service and $75.00 FTA fee payable to Divernon Police Department.

 

Velma Copeland: Defendant present with counsel and State's Attorney present. By agreement, Defendant admits the allegations in the petition to revoke. By agreement, first offender probation revoked and terminated unsatisfactorily with the judgment of conviction entered. By agreement, Defendant ordered to pay $200 per month, starting on 8/15/23. Pay or appear hearing scheduled for 10/25/23 at 9 a.m. Defendant need not appear if current ($600) or paid in full. See written orders. Bond from 21-CF-220 to be transferred and applied.

 

David Crutcher: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8/28/23 at 10 a.m. State to make plea offer today. Discovery ongoing; notice of Victim's Assertion of Rights filed by the State.

 

Ronee Foraker: State's Attorney present. The parties had agreement to return the records but no records have yet been received. Matter continued for return on the subpoena to 8/15/23 at 11 a.m.

 

Joshua Hill: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 10/24/23 at 1:15 p.m. Jury trial scheduled for 11/6/23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Patricia Miller: Defendant present in custody in person with PD Senger and State's Attorney present. Defendant makes statement in allocution. For vreasons stated on the record, contempt order and sentence vacated. Bond hearing conducted. Arguments heard. For reason stated on the record, Defendant ordered released on a $10,000 OR bond subject to the pretrial release order. PD Senger appointed going forward. Preliminary hearing set for in person 9/22/23 at 10 a.m.

 

Cole Montgomery: Defendant present in custody with PD Senger and State's Attorney present. State's motion to continue preliminary hearing granted over objection of the Defendant. Preliminary hearing continued to 7/28/23 at 10 a.m.

 

Laurie Reatherford: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 9/22/23 at 10 a.m.

 

Layla Schuyler: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8/11/23 at 10 a.m.

 

Harold Sirbaugh: State to file moyion for special prosecutor. Defendant's motion to continue granted. Case set for status of preliminary hearing 9/11/23 at 10 a.m. Subpoena continued generally.

 

Nicholas Steele: Parties present by counsel. Defendant is not present but is still in custody. Pretrial hearing continued to 8/28/23 at 10 a.m. Writ to issue.

 

James Williams: Defendant present with counsel and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 8/28/23 at 10 a.m. in person.
