Christian County Court Cases 06/29/23

The following court cases were heard on June 29th, 2023:

 

Russell Crist: Defendant present with Public Defender Senger. Defendant requests jury trial date. Reset pretrial 7/6/23 at 10 a.m. State's offer to remain open until that time.

 

Dalton Dupont: Defendant present with Attorney Casey via Zoom; reset pretrial 8/17/23 at 10 a.m.

Christian County Court Cases 06/27/23

The following court cases were heard on June 27th, 2023:

 

Dalton Allen: Defendant preset with Public Defender. Defendant pleads guilty pursuant to term of sentencing order. Court accepts terms of plea and plea of guilty. Defendant sent pursuant to the terms of the sentencing order. Defendant has a balance of $924 to be paid each month starting July 15.

 

Andrew Calvert: State's Attorney and Public Defender present with Defendant. Case set for a 402 Conference on 8/15/23 at 8:45 a.m. Rest pretrial hearing set for 8/15/23 at 10 a.m.

 

Patrick Carr: Defendant present with Public Defender. Defendant pleads guilty to possession of meth less than 5 grams. Plea accepted. Defendant sent pursuant to sentencing order. Balance of $1,800; application waiver of court assessments, taht bring the balance to $1,251. Defendant to pay $50/month starting 8/1/23  and each month thereafter.

 

Dustin Durbin: Defendant presetnt with Public Defender. Case set for preliminary hearing 7/20/23 at 10 a.m.

 

Dean Ellis: Defendant present with Public Defender. Revised offer received from State. State advises that revised offer open until 7/7/23 at 10 a.m.

 

Michael Handy: Defendant in resident treatment. Reset for status 7/21/23 at 10 a.m.

 

Mathieu Kuhns: Defendant preset with new Attorney McWard. McWard to file substitution of counsel. Public Defender appointment vacated. On motion of Defendant case reset 7/13/23 at 10 a.m.

The following court cases were heard on June 26th, 2023:

 

Dalton Allen: State's Attorney present; Defendant in custody of Christian County Jail with Public Defender Senger. Parties have an agreement but State needs to prepare paperwork. Matter reset for plea presentation on 6/27/23 at 10 a.m.

 

Cheri Cott: State's Attorney present; Defendant in custody of Christian County Jail with Public Defender Senger. Second look hearing of bond hearing; bond reduced to $25,000 (10%), with special provision of obtaining a substance abuse evaluation upon release. Matter set for preliminary hearing on 7/7/23 at 10 a.m.

 

Richard Ginger: Assistant District Attorney; Defendant in custody of Christian County Jail with Public Defender Senger. Admonish Defendant on bond; matter in 18-CF-11 is pre-disposition. Matter set for motion to reduce bond on 7/6/23 at 10 a.m.

 

John Hott, Jr.: Assistant State's Attorney present; Defendant with Public Defender Senger. Parties present a joint, negotiated sentencing proposal. Based on fact that Defendant successfully completed treatment, court will accept terms as recited on record. Defendant re-admitted to probation for a period of 24-months with same terms of previous probation order. Defendant to pay $50/month on all cases beginning on 8/1/23.

The following court cases were heard on June 20th, 2023:

 

Robert Abberley: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8-25-23 at 10 a.m. All appearances must be in person. State to make offer.

 

Samantha Abbott: Parties present by counsel. Defendant currently in inpatient treatment. NTA to issue for 8-29-23 at 10 a.m.

 

Nathan Baker: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 9-19-23 at 1:15 p.m. Jury trial scheduled for 10-2-23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

William Dixon: Defendant present in custody pro se and is a disbled veteran who provides a new address. Special prosecutor not available. Public defender appointed. On motion of the Court, Defendant ordered released on a $5,000 OR bond. First appearance with counsel set for 8-15-23 at 10 a.m.

 

Lucas Fenton: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 7-21-23 at 10 a.m. State has answered dsicovery and made plea offer and PD is reviewing same with client.

 

Billy Hulfachor: Defendant present with counsel. AAG Hegarty and State's Attorney present. By agreement, pretrial hearing continued to 7-21-23 at 10 a.m. State made plea offer last week and PD needs to discuss same with client.

 

David Jones: Defendant present with Public Defender and State's Attorney present. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 8-25-23 at 10 a.m.

 

Stacey Karnes: Defendant present with counsel and Assistant State's Attorney present. Defendant knowingly and voluntarily waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 8-28-23 at 10 a.m. Defendant going to inpatient treatment today.

 

Amy Kasper: Defendant present with Public Defender and State's Attorney present. Defendant waives arraignment, pleads not guilty, and demands trial by jury as to Count II. Pretrial hearing and hearing on a petition to modify bond re operation of motor vehicle scheduled for 6-23-23 at 10 a.m. State made offer in March 2023 and will not amend based on Count II.

 

Alisha Manion: Defendant present pro se in person with Assistant Public Defender Grigsby. Defendant admonished and knowingly and voluntarily waives any conflict of interest with Assistant Public Defender Grigsby. SP DePaepe present. Parties have reached a negotiated resolution whereby the current probation order is modified so that Defendant will serve 30 days of electronic home confinement, starting today and the previous term of 300 hours of public service work is vacated.
Further, the parties agree that less the State files any additional pleadings, the current probation order shall expire and the petition to revoke shall automatically withdrawn 30 days from today. Balance to collections.

 

Michael Morrissey: Defendant present with counsel and Special Prosecutor Havera present. By agreement, pretrial hearing scheduled for 8-15-23 at 10 a.m.

 

Ronald Robinson, Jr.: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury. Pretrial hearing scheduled for 8-22-23 at 10 a.m. Writ continued but Defendant anticipates release from IDOC usotdy back to our jail pending bond.

 

Nicholas Rudolph: Defendant present with counsel and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of possession with intent to deliver cannabis, a class 2 felony. judgment of conviction entered. By agreement, Defendant sentenced to 18 months probation and 4 days in jail with credit for 2 days served. See written orders.

 

Larry Scott: Defendant present remotely from the Illinois Department of Corrections with Public defender and State's Attorney present. Public defender and the process of reviewing transcripts and has a call scheduled with her client later this month to determine whether to amend the pending pro se post-conviction petition. By agreement, status hearing scheduled for 8-29-23 at 10 a.m. Video writ to issue. Defendant to file any amended petitions before the next hearing.

 

Thomas Sipes: Special prosecutor Havera present by phone. Based upon Defendant's medical condition and on motion of the State, Defendant ordered released from custody on a $50,000 OR bond.

 

Jaydin Snow: Defendant present with Public Defender and State's Attorney present. By agreement, preliminary hearing scheduled for 8-21-23 at 10 a.m.

 

Nikki Snow: Defendant present with Public Defender and SP Havera present. State answered discovery and made offer. Defendant had appointment with his attorney yesterday by phone, but had phone issues. He will schedule a new appointment today.

 

Matthew Yattoni: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 7-21-23 at 10 a.m. Parties have reached an agreement but to review his other pending charges in a different county.

The following court cases were heard on June 19th, 2023:

 

Shalee Bayne: Entry of Appearance, Demand for Speedy Trial and Assertion of Right
to Counsel filed by Public Defender Grigsby. Reset for plea 6-21-23.

 

Damery Binkley: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause as to Count II. Court finds no probable cause as to Count II which is dismissed. Defendant waives arraignment, pleads not guilty and demands trial by jury. By agreement, final pretrial hearing scheduled for 7-25-23 at 1:15 p.m. Jury trial scheduled for 8-7-23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing.

Aaron Davis: Defendant fails to appear. Notice to appear to issue for 6-30-23 at 10 a.m. State's request for warrant denied.

 

Dale Detmers: Defendant present with counsel and State's Attorney present. Defendant waives arraignment, denies the allegations in the Petition to Revoke. Pretrial hearing scheduled for 8-22-23 at 10 a.m.

 

Michael Handy: Defendant present with counsel and State's Attorney present. By agreement, status of preliminary hearing scheduled for 6-27-23 at 10 a.m.

 

Matthew Harden: Defendant present by attorney Brown and State's Attorney. By agreemnt, petition hearing continued to 7-17-23 at 10 a.m.

 

Willie Jones: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of Unlawful possession of weapon by a felon (Count IV). Remaining counts dismissed pursuant to negotiated plea. Judgment of conviction entered. By agreement, Defendant sentenced to seven years in the Illinois Department of Corrections, followed by one year of mandatory supervised release, with credit for 182 days served, to be served at the rate of 50%. Defendant assessed financial obligations as set forth in the financial sentencing order. Balance ordered to be sent to collections at the request of the Defendant. See written orders.

 

Brady Knight: Defendant present with Public Defender and State's Attorney present. Case dismissed on motion of the State without prejudice. No further settings.

 

Jacob Krouse: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury. Pretrial hearing scheduled for 6-30-23 at 10 a.m.

 

Austin Mayes: Defendant present with Public Defender in custody of the Sheriff and State's Attorney present. By agreement, status set 7-21-23 at 10 a.m. re DHS taking custody of Defendant for fitness treatment.

By agreement, preliminary hearing scheduled for 7-10-23 at 10 a.m. Case called for hearing on Defendant's Motion for Bond Reduction. Defendant sworn and testifies. Arguments heard. Motion denied for reasons stated on the record without prejudice.

 

Jacob Bright: Defendant present with counsel and State's Attorney present. By agreement, pretrial hearing continued to 8-22-23 at 10 a.m. State has answered discovery and made plea offer. Defendant to schedule and keep appointment with his attorney to review same.

 

Brianna Caldwell: Defendant present with counsel and State's Attorney present. Defendant waives arraignment, denies the allegations in the Petition to Revoke. Pretrial hearing scheduled for 7-18-23 at 10 a.m.

 

William Dixon: Pretrial/First appear set for 6-20-23 at 10:00 a.m. in courtroom A.

Alonzo Hoyer: Parties present by counsel. Defendant took a IDOC plea in Effingham County and is still in their jail but may be transferred to IDOC. Writ to issue. Pretrial reset to 8-22-23 at 10 a.m

 

Drakeem Manning: Parties by counsel. Defendant in treatment. Status reset to 7-21-23 at 10 a.m.

 

Jaycie Rogers: Defendant present with counsel and State's Attorney present. By agreement, pretrial hearing continued to 7-28-23 at 10 a.m. Defendant in treatment.

 

Anthony Sexton: Defendant present with counsel and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 7-28-23 at 10 a.m. Defendant will waive preliminary hearing at that time. Parties have plea but need to work out some terms with his employment.

Christian County Court Cases 06/15/2023

The following court cases were heard on June 15th, 2023:

 

Sherie Aymer: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of Theft (Count II). Count I dismissed pursuant to negotiated plea. Judgment of conviction entered. By agreement, Defendant sentenced to two years probation, four days in jail with credit for two days served, and she's ordered to pay fines and fees as set forth in the financial sentencing order. Shalee Bayne: Defendant present with counsel and State's Attorney present. Defendant waives arraignment, denies the allegations in the Petition to Revoke. Pretrial hearing scheduled for 6-19-23 at 9 a.m.

 

Tiffany Burke: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 7-20-23 at 10 a.m. Defendant still in treatment and will make a counter offer.

Proceed on bond arguments made; bond set in the amount of $7,500 (10%). APD Grigsby appointed to represent defendant going forward for his case-in-chief. Defendant anticipates filing a motion to reduce bond; matter set for FAWC/Motion to reduce bond on 6-16-23 at 10 a.m.

 

Christopher Carnahan: SA McWard present; Defendant in custody of Christian County jail with APD Grigsby; PSC referral denied. Before ordering an updated PSI, Defendant to review pending plea offer. Matter set for status hearing on 6-20-23 at 10 a.m. If no agreement, court to order an updated PSI at that time.

Devon Gatons: Defendant fails to appear, Assistant State's Attorney present. Warrant issued at $50,000, 10% for Christian and surrounding counties only.

 

Patricia Hornbuckle: Court reviewing the file contacts Fayette County State's Attorney Mathis; she indicates she has no conflict of interest in this matter. Brenda Mathis is appointed as Special Prosecutor to represent the people going forward. 6-7-23 status hearing is vacated; matter is reset for further status hearing on 6-21-23 at 10 a.m.

 

Jeramiah Johnson: Defendant present in court with Attorney Finks present virtually, Assistant State's Attorney present. Plea hearing scheduled for 6-29-23 at 10 a.m.

Christian County Court Cases 06/06/2023

The following court cases was heard on June 6th, 2023:

 

Drakeem Manning: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 6-12-23 at 10 AM. Furlow previously granted Defendant has not yet gone to treatment but will be screened today.

 

David Moma: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of aggravated battery (Count II). Count I dismissed per plea. Judgment of conviction entered. By agreement, Defendant sentenced to two years and the only Department of Corrections followed by up to one year mandatory supervised release, to be served at the rate of 50%, credit for time served at 127 days. Defendant assessed a $500 fine plus assessments. Defendant sworn and testifies. Petition for waiver granted. See written orders.

 

Joshua Wells: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant lower 48 State of the United States. Bond set at $200,000 over objection of Public defender.

Christian County Court Cases 06/05/2023

The following court cases was heard on June 5th, 2023:

 

Melinda Kraut: Special Prosecutor present and Defendant present with PD Rahar. New counsel on both sides. Pretrial hearing set to 8-1-23 at 10 a.m.

 

Jesse Lacy: Defendant present with Public defender and Special Prosecutor Kurtz present remotely. Case called for hearing on Defendant's Motion for Bond Reduction. Defendant sworn and testifies. Arguments heard. Motion denied for reasons stated on the record. Sheriff ordered to comply with all treatment recommendations of Defendant's pulmonologist. Defendant shall be permitted to keep any inhalers with him in his cell but shall only use them as directed and shall not permit anyone else to use them. State has one additional report of a victim interview and will disclose same. By agreement, hearing on State's 115-10 motion scheduled for 8-15-23 at 1:15 p.m.

The following court cases was heard on June 2nd, 2023:

 

Charles Carron: Defendant fails to appear. Notice to appear to issue for 7-18-23 at 10 a.m.

 

Terrence Gilford: Defendant present with Public Defender and State's Attorney DePaepe present. Cased dismissed without prejudice on motion of the State.

 

Patricia Hornbuckle: Special Prosecutor DePapee appears for people; Attorney Barrows for Defendant; SA McWard may have a conflict and therefore court to appoint a special prosecutor; court will inquire if Fayette County State's Attorney to see if she can handle case. Reset for Status hearing on 6-7-23 at 10 a.m.

 

Michael Handy: Defendant present in custody with PD Senger who is one and represented by agreement of the parties. SA DePaepe present. Defendant admonished regarding the charge is impossible penalties. Proffer made. Probable cause found. Bond hearing conducted for reasons stated ont he record, court imposes cash bond in the amount of $10,000. By agreement, Defendant's oral motion for furlough to attend inpatient substance abuse treatment granted upon the availability of event. Written order to follow. Defendant ordered not to be released until written order is entered with treatment plan specifics. First appearnce with counsel scheduled for 6-19-23 at 10 a.m.

 

Jessie Lacy: Defendant present remotely in custody with Public defender and Special Prosecutor Kurtz present. Bond hearing remains set 6-5-23 at 10 a.m.
