Christian County Court Cases 11/29/23

The following cases were heard on November 29th, 2023:

 

Bobbie Abberley: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 12/4/23 at 10 a.m. in person.

 

David Crutcher: Defendant present in person in custody with Public Defender Senger; State's Attorney present. Case called for hearing on Defendant's motion to suppress his statement based upon lack of recording. State confesses the motion. Defendant's statement is suppressed. Pretrial hearing and hearing on the motion to remove monetary conditions of bail scheduled for hearing on 12/11/23 at 10 a.m.

 

Robin Jones: Defendant persent with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/8/24 at 10 a.m. Defendant currenlty in treatment.

 

Brandie Jordan: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/16/24 at 10 a.m.

 

Austin Mayes: Defendant present with PUblic Defender in custody of the Sheriff and State's Attorney present. Parties stipulate to admission of IDHS 90 days report. court find Defendatn has been restored to fitness. See written order. Hearing on the motion to remove monetary conditions of pretrial release scheduled for hearing on 12/1/23 at 10 a.m.

 

Anthony Pakovich: Defendant present in person and in custody on new charges with Public Defender Senger. Assistant Public Defender Grigsby is appointed to represent Defendant going forward. Defendant indicates he still may try to hire private counsel. Stat'e sAttorney present. Case called for hearing on petition to revoke pretrial release. Proffer made. Arguments heard; motion granted for reasons stated on the record. Defendant's pretrial release is revoked and he is ordered into the custody of the Sheriff pending trial. See written order. In person preliminary hearing scheduled for 12/15/23 at 10 a.m.

 

Ashley Pults: Defedant present in person and in custody with Assistant Public Defender Grigsby. Assistant States Attorney present. Case called for preliminary hearing and detention hearing. Officer is sworn in and testifies. Arguments heard; petition for dtention granted for reasons stated on teh record. See written order. Safe Passage is authorized to schreen the Defendant at the county jail for inpatient substance abuse treatment. The parties anticipate and agreed furlough order if a treatment is found. Defendant waives arraignment pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 1/18/24 at 10 a.m. Defendatn admonished regarding her appeal rights.

 

Jerry Riggs: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/15/23 at 10 a.m. Continued detention hearing conducted and Court finds continued detention warranted for reasons stated on the record. Defendant admonished regarding his right to appel. All other pending matters continue for pretrial to 12/15/23 at 10 a.m.

 

Larry Skinner: Defendant present in person and in custody with counsel and State's Attorney present. Case called for sentencing hearing. Arguments made regarding sentencing alternatives. Defendant declines to make a statement and allocution. for reasons stated on the record, Defendant is sentenced to 10 years in the Illinois Department of Corrections followed by 18 months of mandatory supervised release, to be served at the rate of 50%, with credit for 755 days previously served through today. Court declines to impose any financial obligations based up the Defendant's current financial situation and any fine imposed would be reduced to zero based upon pretrial incarceration credit.

 

Derik Steck: Defendant present in person and in custody with Public Defender Senger, who has a conflict of interest and cannot represent the Defendant for the initial appearance or detention hearing. Public Defender Herkert has been appointed to represent the Defendatn. State's Attorney present. first appearnce and detention hearing continued to 11/30/23 at 10 a.m. All other pending matters set for status on that date.

 

Alyxis Whitcomb: Defendant present with Public Defender and Sate's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause as to Counts I and III. No probale cause found as to Count II which is dismissed without prejudice. Defendatn waives arraignment, pleads not guilty and demands trial by jury. Final pretrial hearing scheduled for 1/23/24 at 1:15 p.m. Jury trial scheduled for 2/12/24 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before teh jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Dennis Wilcutt: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 12/7/23 at 10 a.m. For reasons stated on teh record, the Court finds continued detention necessary and that order shall remain in effect. Defendant admonished regarding possible right to appeal this order.
