Christian County Court Cases 11/30/23

The following cases were heard on November 30th, 2023:

 

Aaron Davis: Defendant present with Public Defender and State's Attorney present. State's attorney has conflict of interest and will seek the appointment of a special prosecutor. Pretrial 1/12/24 at 10 a.m.

 

Dustin Durbin: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/19/24 at 10 a.m.

 

Rocky Ford: Defendant present in person pro se and Assistant State's Attorney present. For reasons stated on the record, petition to revoke withdrawn and probation terminated. Balance previously forwarded to collections.

 

Melissa Foreman: Defendant present with counsel and Assistant State's Attorney
present. Parties present proposed plea agreement to amended, misdemeanor battery charge. Alleged victim present in the courtroom and objects. State indicates they have knowledge of some potentially exculpatory evidence but have not yet reviewed same with the alleged victim. Court will not accept the plea agreement today but requests that the alleged victim be given an opportunity to review the evidence mentioned in court today. Pretrial hearing scheduled for 12/21/23 at 10 a.m.

 

Jacob Melton: Defendant present by Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/25/24 at 10 a.m. Defendant's presence excused due to medical condition.

 

Michael Morrissey: Public Defender present, Assistant State's Attorney present. State provides probable cause; Court finds probable cause. Matter set for first appearance/detention hearing on 12/1/23 at 1 p.m.

 

Samantha Olivio: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 1/18/24 at 10 a.m. at 10 a.m. Parties have a possible hybrid plea agreements that would involve a consecutive sentence to treatment court. Defendant needs to complete all of the evaluations. Defendant ordered to immediately report to the probation department to determine what else needs to be done to complete the evaluation process.

 

Robert Scott: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 2/20/24 at 10 a.m.

 

Derik Steck: Defendant present in person and in custody with Conflict Public Defender Herkert and State's Attorney present. Case called for hearing on State's petition to deny pretrial release and preliminary hearing. Witnesses sworn and testify. Arguments heard. Court finds probable cause and that the State has met its burden of proof by clear and convincing evidence on the petition to deny pretrial release. Defendant ordered detained until trial for reasons stated on the record. See written order. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 1/11/24 at 10 a.m.

 

Brent Woodall: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 12/12/23 at 1:15 p.m. Jury trial scheduled for 1/2/24 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions by 12/8,23 to be heard at the final pretrial hearing. Trial in abstentia admonition given. Defendant admonished regarding the charges and possible penalties as to Count V. Parties are unclear whether the previous preliminary hearing was sufficient to encompass the allegations in the new count. Preliminary hearing as to count 5 scheduled for 12/11/23 at 10 a.m. Court reviewed continued detention order and finds that the reasons for detention still exist and the order shall continue. Defendant admonished regarding potential right to appeal.
