Christian County Court Cases 8/24/23

The following cases were heard on August 24th, 2023:

 

Zachary Bland: Defendant present with counsel and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 9/14/23 at 10 a.m. remotely.

 

Sonia Davis: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $5,000 over objection of the Public defender.

 

Kasey Fitzgerald: Proposed order filed.

 

Melissa Foreman: Defendant fails to appear but allegedly appeared and left before her case was called. Defendant's attorney appears remotely but had bad connection. State's Attorney present. State has not yet made plea offer. State answered discovery. Pretrial hearing set 10/12/23 at 10 a.m.

 

Bradley Gobert: Defendant present in person with PD Senger and ASA DePaepe present. Case dismissed on motion of the State based upon the request of the alleged victim. No fuurther settings.

 

Georg Goins: Defendant present with counsel and State's Attorney present. By agreement, status of preliminary hearing set for 9/8/23 at 11 a.m. PD Senger's appointment is vacated.

 

Allison Grothaus: Parties by counsel. By agreement, pretrial continued to 9/22/23 at 10 a.m. Video writ to issue.

 

Cole Montgomery: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of aggravated fleeing or attempting to elude a police officer. Judgment of conviction entered. By agreement, Defendant sentenced to two years probation, 104 days in jail with credit for 57 days served and he is ordered to pay fines and assessments as set forth in the financial sentencing order. Bond in any cases to be applied. See written orders.

 

Joseph Moore: Defendant present with counsel and State's Attorney present. For reasons stated on the record, warrant quashed and rule to show cause vacated. By agreement, final pretrial hearing scheduled for 11/21/23 at 1:15 p.m. Jury trial scheduled for 12/4/23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Patrick Motley: Defendant present in custody with Public Defender and State's
Attorney present. Case called for further hearing on petition to modify bond and on motion for furlough. Arguments heard. Motion for furlough denied for reasons stated on the record and the motion to modify bond is granted. Cash bond set at $50,000 total for all pending cases subject to the terms of the pretrial release order. Pretrial hearing 9/22/23 at 10 a.m. TC referral pending.

 

Robin Parsons: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 11/21/23 at 1:15 p.m. Jury trial scheduled for 12/4/23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given. Pretrial/possible plea hearing set 9/14/23 at 10 a.m. Defendant has a possible 4 county agreement to resolve everything.

 

Justin Sexton: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 11/21/23 at 1:15 p.m. Jury trial scheduled for 12/4/23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given. Writ to issue. All other pending cases are set for pretrial at the time of the final pretrial in this case.

 

Jenna Sparling: Defendant present with Public Defender Herkert and Asst. State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of theft (Count I). Count II dismissed per negotiated plea. No judgment of conviction entered. By agreement, Defendant sentenced to 2 years of 2nd chance probation and she is ordered to pay the fines and assessments. See written orders. Counsel only status set.

 

Michael Staten, Jr.: Defendant present with Public Defender and State's Attorney present. By agreement, case continued for presentation of negotiated plea on 9/21/23 at 10 a.m.
