Christian County Court Cases 8/14/23

The following cases were heard on August 14th, 2023:

 

Joshua Bland: Defendant present with counsel and State's Attorney present. By agreement, pretrial hearing continued to 8/22/23 at 10 a.m. TC staffing to be done this week.

 

James Eiskant: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. State granted leave to amend the information by interlineation in open court. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury. By agreement, final pretrial hearing scheduled for 9/19/23 at 1:15 p.m. Jury trial scheduled for 10/2/23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given. State to file 115-10 motion and possibly motion to admit prior convictions to be filed on or before 8/18/23. Hearing on those motions set 8/31/23 at 2 p.m.

 

Robert Gerk: Defendant present pro se and State's Attorney present. Defendant admonished regarding PTR. Defendant requests time to hire private counsel. By agreement, first appearance with counsel scheduled for 11/20/23 at 10 a.m.

 

Skye Halleman: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $5000 over objection of the Public defender. Warrant stayed until 8/15/23 at 10 a.m.

 

Willie Johnson: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 10/24/23 at 1:15 p.m. Jury trial scheduled for 11/6/23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given. Writ continued.

 

Andrea McDonald: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 8/29/23 at 10 a.m.

 

Patrick Motley: Defendant present in custody with Public Defender and State's Attorney present. Defendant admonished re petition to modify bond which is set for hearing on 8/17/23 at 10 a.m.

 

Brent Musser: Defendant present with Public Defender and State's Attorney present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of aggravated fleeing or attempting to elude. Judgment of conviction entered. By agreement, Defendant sentenced to three years Illinois Department of corrections followed by up to one year mandatory supervised release, to be served rate of 50%, with credit for time served of 465 days. Sentence to run concurrently with sentences from Shelby County case 22-CF-59 and 21-CF-130. Defendant assessed a $500 fine plus assessmenst. Bond in any other pending matters ordered transferred and applied after paying any incidental expenses. Any outstanding warrants in any other cases are quashed. See written orders.

 

Alma Nerone: Defendant present by Asst. Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 9/14/23 at 10 a.m. Defendant was admitted to PSC in Sangamon County and is currently serving a county jail sentence for a sanction until 8/31/23. If the case is not resolved at the next hearing, it will be set for trial.

 

Ricky Painter: Defendant present remotely with Public Defender and State's Attorney present. By agreement, plea hearing continued to 8/17/23 at 10 a.m. in person.

 

Rexton Pruitt: Defendant present pro se and State's Attorney present. Defendant admonished regarding charges, penalties, and rights. By agreement, Public Defender appointed to represent Defendant. Preliminary hearing scheduled for 10/10/23 at 10 a.m. in person.

 

Jada Reeves: Defendant present remotely with counsel and State's Attorney present. State's Attorney has a conflict and will file motion for appointment of special prosecutor. First appearance with counsel continued to 9/11/23 at 10 a.m.

 

Kyle Sheley: Defendant present pro se and State's Attorney present. Defendant admonished regarding charges, penalties, and rights. By agreement, Public Defender appointed to represent Defendant. Preliminary hearing set 10/10/23 at 10 a.m. in person.

 

Keith Westbrook: State's Attorney present. Defendant fails to appear and has failed to file a proposed order. Notice to appear to issue for 9/14/23 at 10 a.m.

 

Timothy Wiseman: Defendant present pro se and State's Attorney present. Defendant still seeking to hire private counsel, but has been unable to do so due to an injury. First appearance reset to 9/26/23 at 10 a.m.
