Christian County Court Cases 04/21/2023

The following court cases were heard on April 21st, 2023:

 

Kyle Adkins: Defendatn present with Public Defender and State's Attorney present. State's motion to dismiss is granted.

 

Matthew Beck: Defendant present with counsel and SP DePaepe present. Negotiated
plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of possession of methamphetamine (Count I). Remaining counts dismissed pursuant to negotiated plea. By agreement, Defendant sentenced to four years in the Illinois Department of corrections followed by one year of mandatory supervised release, to be served at the rate of 50%, with credit for 271 days served. Defendants assessed the fine and assessments set forth in the financial sentencing order. Bond in any cases order to be applied in any remaining balance to be sent to collections. Sentence to run concurrent to the sentence imposed in 21-CF-219. See written orders.

Defendant present with counsel and SP DePaepe present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of aggravated fleeing and eluding a peace officer (Count III). Remaining counts dismissed pursuant to negotiated plea. By agreement, Defendant sentenced to 2 years in the Illinois Department of corrections followed by up to one year of mandatory supervised release, to be served at the rate of 50%, with credit for 0 days served. Defendants assessed the fine and assessments set forth in the financial sentencing order. Bond in any cases order to be applied in any remaining balance to be sent to collections. Sentence to run concurrent to the sentence imposed in 22-CF-75. See written orders.

Defendant present with counsel and SP DePaepe present. Negotiated
plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of escape By agreement, Defendant sentenced to 2 years in the Illinois Department of corrections followed by up to one year of mandatory supervised release, to be served at the rate of 50%, with credit for 0 days served. Defendants assessed the fine and assessments set forth in the financial sentencing order. Bond in any cases order to be applied in any remaining balance to be sent to collections. Sentence to run consecutively to the sentences imposed in 21-CF-219 and 22-CF-75. See written orders.

 

Shayla Caraker: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for at 7-25-23 at 1:15 p.m. Jury trial scheduled for 8-7-23 at 8:30 AM. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Kevin Carrell: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for at 7-25-23 at 1:15 p.m. Jury trial scheduled for 8-7-23 at 8:30 AM. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Matthew Cunningham: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 5-30-23 at 10 a.m.

 

Levi Durbin: Defendant present with counsel and State's Attorney present. Motion to revoke withdrawn motion of the state. No further settings.

 

Patricia Hornbuckle: State's Attorney Erickson w/response VIA video; motion partially gratned; Resp may travel to the State of South Carolina and Florida until 4-30-23. Defendant must provide proof of flights and sign extradition waiver prior to leaving; CT denies at this time the second trip; Resp may bring this motion at a later time.

 

Allison Grothaus: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $15,000 over objection of Public Defender.

 

Sierra Hatfill: Defendant present with counsel and State's Attorney present. PTR hearing scheduled for 6-23-23 at 11 a.m. in person. Defendant goes by Parker.

 

Amy Kasper: Defendant present with Public Defender and State's Attorney present. Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury. Pretrial hearing scheduled for 6-20-23 at 10 a.m. Records received pursuant to SDT from St. John's Hospital turned in open court to the State who is order to provide a copy to Public Defender.

 

Brandon Keppler: Defendant present with counsel and State's Attorney present. By agreement, final pretrial hearing scheduled for 9-19-23 at 1:15 p.m.. Jury trial scheduled for 10-2-23 at 8:30 a.m. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing. Trial in abstentia admonition given.

 

Charles Lair: Defendant present with counsel and State's Attorney present. Pretrial hearing continued to 4-24-23 at 10 a.m.

 

Ashley Layton: Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $15,000 over objection of Public Defender.

 

Mitchell Manion: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 5-16-23 at 10 a.m. PSC referreal pending.

 

Heaven Miller: Defendant present with Public Defender and State's Attorney present. Defendant enters an open admission to the allegations in teh petition to revoke without an agreement as to sentence being fully admonished. Probation department ordered to prepare presentence investigation report. In person sentencing hearing scheduled for 6-19-23. Defendant admonished regarding sentencing in her absence.

 

Michael Neece: Defendant present with counsel and State's Attorney present. Negotiated plea presented and approved by the court, whereby Defendant pleads guilty to the charge of unlawful possession of weapon by felon (Count III). Remaining counts dismissed. Judgment of conviction entered. By agreement, Defendant sentenced to 3 years IDOC plus 1 year MSR with CTS of 172 days. Defendant assessed a $20,000 fine plus assessments. Bond to apply. Any remaining balance sent to collections.

 

Marla O'Dell: Defendant present with counsel and SP Kroncke present. Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraingnment, pleads not guilty and demands trial by jury. Pretrial hearing scheduled for 5-18-23 at 10 a.m.

 

Gregory Reber: Judge Paisley recused.

 

Jeremy Reiss: Defendant present with Public Defender and State's Attorney present. By agreement, pretrial hearing continued to 6-2-23 at 10 a.m. PSC referral denied.
