Christian County Court Cases 04/18/23

The following court cases were heard on April 18th, 2023:

 

Robert Abberley  Defendant fails to appear. Warrant to issue. Geographic limits of the warrant are Christian County and surrounding counties. Bond set at $30,000 over objection of Public defender.

 

Paul Allen Jr.   By agreement, pretrial/possible plea hearing set to 4-25-23 at 10 a.m.

 

Jacob Bright Case called for preliminary hearing. Officer sworn and testifies. Court finds probable cause. Defendant waives arraignment, pleads not guilty and demands trial by jury. Pretrial hearing scheduled for 6-16-23 at 10 a.m.

 

Joshua Emmerling Defendant present with Public Defender and Special Prosecutor DePaepe present. Negotiated plea presented and approved by the Court, whereby Defendant pleads guilty to the charge of unlawful possession with intent to deliver methamphetamine. Judgment of conviction entered. By agreement, Defendant sentenced to two years probation, 28 days in jail with credit for 14 days served, he is ordered to pay the fine and assessments. Petition for waiver granted.

 

Debbie Horn   By agreement, preliminary hearing continued 4-24-23 at 10 a.m. Sub continued.

 

Michael Kline  By agreement, pretrial hearing continued to 06/20/23 at 10 AM.

 

Brady Knight  Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 6-19-23 at 10 a.m.

 

Nathan Livingood By agreement, final pretrial hearing scheduled for 7-25-23 at 1:15 PM. Jury trial scheduled for 8-7-23 at 8:30 AM. Both hearings are in person. Parties ordered to file pretrial motions at least 30 days before the jury trial to be heard at the final pretrial hearing.

 

David Moma  By agreement, pretrial hearing continued to 04/25/2023 at 10 AM. Case called for hearing on motion for bond reduction. Arguments heard. Motion granted for reasons stated on the record. Bond reduced to $10,000.70 to the terms of the pretrial release order.

 

Diamond Momoh   Public defender's appointment vacated. State's Attorney Present. By agreement, pretrial hearing continued to 5-8-23 at 10 a.m.
 
Samantha Olivio Defendant knowingly and voluntarily waives preliminary hearing. See written waiver. Defendant waives arraignment, pleads not guilty, and demands trial by jury. Pretrial hearing scheduled for 06/01/2023 at 10 AM.

 

Timothy Richardson  By agreement, final pretrial hearing scheduled 7-25-23 at 1:15 PM. Jury trial scheduled for 8-7-23 at 8:30 AM. Both hearings are in person.

 

Larry Scott  By agreement, pretrial continued to 06/20/2023 at 10 AM.

 

Jennifer Smith  By agreement, status hearing scheduled for 06/23/2023 at 10 AM.

 

Patrick Weaver Rule to show cause vacated on motion of the Defendant based upon order entered on 04/17/2023 at 10 AM. Case remains scheduled for 6-30-23 at 10 a.m.

 

John Zini  Defendant fails to appear. Warrant to issue. Geographic limit of the warrant is Christian County. Bond set at $10,000.
