Christian County Court Cases 9/8/16

These are the results of the following court cases heard on 09/08/2016 at The Christian County Courthouse.

 

14CF112 - Alex M. Collingwood - Pre-trial - Defendant has successfully completed in-patient treatment and completed his payment order. State requested further pretrial to further monitor the status of the case. Set for November 3rd.

 

16CF111 - Brian J. Durbin - Appearance with counsel - Defense no longer wants his attorney to represent him and wanted a public defender. State had no objection to the removal of counsel.

 

16CF106 - Vincent B. Page - Status hearing - Defence has a drug court anaylisis, state wants to know if he’s a candidate for mental health court. Further hearing set for September 15th.

 

16CF116 - Stephen L. Reiss - Motion/Reduce Bail - Defense said that the evidence that the state has presented is problematic at best, and asked for bond to be reduced to $10,000. State objected to the motion due to the serious nature of the charge and the evidence presented so far in the case. Defense argued that none of the previous evidence shows the defendant actually participating in the crime. Only being present while the crime was being committed. Court denied the motion based on the request of $10,000. Said he would reconsider if defense able to post a higher bond. Same dates set for further pretrial and jury trial.

 

14CF036 - Alexander B. Shanks - Status Hearing - Defense has filed motion to seek additional credit for time served. Had previously pleaded guilty and was given 68 days credit. State unsure what the basis was of the request. Defense said he would received 109 days credit for his sentence for the total days served for both. Court said that the DOC was calculating the days credit served correctly. Previous defense attorney said that the defense was correct and that they had had the discussion regarding the days credited served. State wanted to look at the transcripts for the plea agreement to find out what exactly was heard. Next hearing set for October 23rd. Previous defense attorney assigned to represent defense.

 

14CF179 - Alexander B. Shanks - Status Hearing - Defense has filed motion to seek additional credit for time served. Had previously pleaded guilty and was given 41 days credit. State unsure what the basis was of the request. Defense said he would received 109 days credit for his sentence for the total days served for both. Court said that the DOC was calculating the days credit served correctly. Previous defense attorney said that the defense was correct and that they had had the discussion regarding the days credited served. State wanted to look at the transcripts for the plea agreement to find out what exactly was heard. Next hearing set for October 23rd. Previous defense attorney assigned to represent defense.

 

15CF165 - Robert A. Stivers - Pre-trial - State hasn’t had a chance to review motion filed by defense and wanted more time to review it. Defense informed court that the medical examiner involved with the investigation of the case would be available to testify on findings. Court is still deciding if additional charges will be filed. Defense said that they cannot continue a defense without expert testimony from medical expert. Autopsy in the case has been received and details will be reviewed within the next week. Further pretrial set for further pretrial on September 15th.

 

16CF042 - Robert A. Stivers - Pre-trial - State hasn’t had a chance to review motion filed by defense and wanted more time to review it. 16CF096 - Luke W. Waddington - Pre-trial - Defense and state working out a plea deal. Date set for possible plea on November 14th.


16CF197 - Lonnie R. Wilkerson - Motion/Reduce Bail - Defense testified that he moved from Texas to Illinois to live with his brother and eventually return to college. Said he has no prior felonies and has never missed court. Said if he was let out he would stay in one place and attend all court dates. State asked if he has any other aliases. Defense said he has a nickname but doesn’t commonly use it. Defense argued that the defendant has no felony background and doesn’t have a means to post bond. State said that they do have a prior criminal record under the nickname Sylvester, including several theft charges. Defense asked for more time to sort out the details for the previous nickname. Set for September 15th.
