Christian County Court Cases 9/6/16

These are the results of the following court cases heard on Tuesday, September 6th at the Christian County Courthouse.

 

16CF189 - Budds, Keith E - Motion to Reduce Bail - Defendant testified that he has a fairly clean criminal record. Defense argued that he has no previous criminal record, and has spent his entire life in Pana. Said there is no indication to flee, nor would he fail to appear. Said he can’t post a $50,000 bond, but can post a $20,000 bond. State objected to bond reduction due to nature of offense. Motion denied. Court said $50,000 is a fairly low bond for the charge.

 

15CF083 - Coghlan, James R - PreTrial - Defense has been talking to state as to whether or not a previous offer is still open. Defense asked for further pretrial for a potential 402 conference. Court stated how a 402 will probably not happen due to previous charges. Defense said he’s wanting to seek help for a drug addiction. Court said the defense is free to file a motion for a drug assessment. Matter continued for further pretrial.

16CF030 - Ford, Brian A - PreTrial - State says there was a miscommunication with the State Police regarding a file pertinent to the case. Defense requesting further pretrial to go over the facts of the case once again. Further pretrial set for September 26th.

 

13CF071 - Ford, Brian A - PTR/PreTrial - State says there was a miscommunication with the State Police regarding a file pertinent to the case. Defense requesting further pretrial to go over the facts of the case once again. Further pretrial set for September 26th.

 

16CF196 - Hayes, Gary R Jr - Motion to Reduce Bail - Defendant testified that he is not employed at this time, and has no prior convictions either in Illinois nor in his previous residence in Texas. State questioned a previous charge in Texas. Defense argued that the Texas matter was a miscommunication and didn’t result in a conviction, so he has no previous convictions at this time, and asked for bond to be reduced to $5,000. State objected to bond reduction stating that they feel that bond is reasonably set. Motion denied. Court said bond was set reasonably. Preliminary hearing set for September 22nd.

 

13CF178 - Kee, Adam J - PreTrial - Defendant has a counseling appointment set for today. Court asked about an admission to PTR in March, yet defendant is just now seeking counseling. Court orders defendant to report to probation and sets a sentencing hearing for November 14th, with further pretrial on November 4th.

 

16CF064 - Merritt, Eric J - PreTrial - There was some confusion as to whether or not defendant has been drug tested with the probation department. Defendant says he has been several times, court only has record for once. Defendant also supposed to be on color system, and defendant informed court that he isn’t. Court called probation officer, who informed he wasn’t aware of the color. Matter will be set for status on the discrepancies on September 29th.

 

16CF129 - Morrissey, Michael T - Plea - Client doesn’t appear in court. Says he’s returning to Taylorville after leaving over the holiday weekend. Defense asks for 48 hours to return before a FTA warrant is issued. State objected the delay of a warrant due to a new battery charge. Warrant issued with a $50,000 bond for Christian and surrounding counties.
