Christian County Court Cases 8/4/17

These are the results of the following court cases heard in the Christian County Court on Friday, August 4th:

 

17CF152 - Nathaniel Z. Bain - Possession of a Controlled Substance and Delivery of a Controlled Substance  - First Appearance with Counsel. New charge of Delivery read to defendant. Preliminary hearing scheduled for August 31 at 10 a.m.

 

17CF111 - Justin M. Bright - Domestic Battery with a Prior and Aggravated Battery in a Public Place - Preliminary Hearing. Also 17CF109 - Criminal Trespassing to Residence with Person Present and 2 Counts of Battery, 17CF008 - Possession of Meth Less Than 5 Grams, and Multiple Traffic Charges. Preliminary hearing in 17CF111 is waived. Formal arraignment is waived, not guilty plea entered. Trial in 17CF109 and 17CF111 set for September. Pre-trial set for August 28 at 10 a.m.

 

17CF122 - Jaysen M. Crose - Possession of Meth Less Than 5 Grams and Possession of a Syringe/Needle/etc. - Arraignment. State has made an offer. Defense is willing to take that plea. Next court date scheduled for August 7 at 10 a.m. to file the negotiated plea.

 

17CM079 - Patrick D. Emmerling - Retail Theft Less Than $300 - First Appearance with Counsel. Negotiated plea is reached. Defendant will serve 30 days in jail. Payment hearing will be scheduled for October 4 at 9 a.m.

 

17CF061 - Jacob C. Krouse - Possession of a Controlled Substance - Pre-trial. State has made an offer. Defense counsel requests a week to talk about the offer with family. Pre-trial set for August 11 at 10 a.m.

 

17CF155 - Dylan M. McConnell - Criminal Damage to Property Between $500 and $10,000 and Child Endangerment - Motion to Reduce Bail. Defendant testifies on his own behalf. Motion is denied without prejudice, but probation will be sent to talk to defendant to do a risk assessment. Status hearing set for August 11 at 10 a.m.

 

17CF130 - Gerald L. Olive - Aggravated Battery and Aggravated Battery of a Child or Disabled Person - Preliminary Hearing. Hearing continued. Status hearing to be held August 31 at 10 a.m.

 

16CF101 - Justin L. Sexton - Burglary - Motion Hearing. State is accusing defense of failing to cooperate with probation. Defense denies the allegations. Order will be entered that defense failed terms of first offender initiative program, and is discharged from program. Trial scheduled for November, pre-trial scheduled for October 26 at 10 a.m.

 

17CF140 - Rodney D. Sizemore - Criminal Damage to Government Property Less Than $500. Appearance with Counsel. Also 17CF128 - Receiving Possession of a Stolen Vehicle and multiple traffic charges. Preliminary hearing is waived in 17CF140. Jury trial set for September, pre-trial set for August 28? at 10 a.m. In 17CF128 - Preliminary hearing proceeds. State calls Taylorville police officer Kyle Mense as a witness. Probable cause is found. Formal arraignment is waived. Jury trial set for September. Pre-trial set for August 28.

 

17CM074 - Randy L. Sparling - Criminal Damage to Government Property Less Than $300 - Pre-trial. State has made an offer that the defense has rejected. Trial date set for September. Final pre-trial scheduled for August 28 at 10 a.m.

 

17CF144 - Shane Trudeau - Criminal Trespassing to Residence with Person Present - Preliminary Hearing. Also 17CM004 - 2 counts of Domestic Battery. Parties have agreed to continue preliminary hearing until August 11 at 10 a.m.

 

17CF149 - Justice T. Stalling - 2 counts of Meth Delivery Less Than 5 Grams - First appearance. Charge was read. Public defender was appointed. Preliminary hearing scheduled for September 1 at 10 a.m.

 

17CM105 - Paul E. Allen - Battery - First Appearance. Also 17CF098 - Criminal Damage to Property Between $500 and $10,000 and Domestic Battery - Petition to Revoke / Pre-trial. New charge of Battery read to defendant. Probable cause is given. Bond set at $100,000. Public defender appointed. First appearance with counsel scheduled for August 10 at 10 a.m.
