Christian County Court Cases 7/11/17

These are the results of the following court cases heard in the Christian County Court on Tuesday, July 11th:

 

17CF033 - Damin L. Barrett - Possession of Meth Less Than 5 Grams and Felony Possession / Use of a Firearm by a Felon - Pre-trial. Trial scheduled for Monday. Second charge was read. Preliminary hearing scheduled for August 7th at 10 a.m., with a pre-trial also scheduled for that day. Jury trial date will be set on pre-trial date.

 

15CF159 - Jaysen M. Crose - Aggravated Battery and Unlawful Restraint - Petition to Revoke / Pre-trial. Also 17CF122 - Possession of Meth Less Than 5 Grams and Possession of Syringe / Needles - Motion to Reduce Bail. Denial of Petition to Revoke is indicated. Defense requests matter be continued. Discovered that preliminary hearing was not set. New traffic charge read to defense. Public defender appointed to handle traffic charge as well. Bond hearing and preliminary hearing scheduled for July 28th at 10 a.m.

 

16CM235 - Johnathan M. Daugherty III - Criminal Damage to Property Less Than $300, Criminal Trespass to Land, License In Possession - Appearance with Counsel. Did not appear. State says Daugherty lives out of state and a guilty plea was shipped to the State’s Attorney’s office. Defendant pleads guilty to third count, first two counts are dismissed.

 

17CF059 - Danielle L. Johnson - 3 counts of Narcotics Possession - Pre-trial. Continued until July 18th at 10 a.m.

 

15CF153 - Leeanne Kinsella - Driving Recklessly / Suspicion of DUI and 2 counts of Aggravated DUI - Pre-trial. Negotiated Plea is reached. Judge recuses herself of taking plea because of prior experience with defendant representing an underlying case to this one.

 

17CF099 - Joseph A. Leckner - Aggravated Battery of a Peace Officer and Resisting a Peace Officer - Pre-trial. Also 17CF054 - Failure to Register as a Violent Offender, 17CF129 - Possessing Contraband in a Penal Institution and Multiple Traffic Charges. 17CF129 charge was read to defense. Preliminary hearing on 17CF129 is scheduled for August 1st at 10 a.m. Jury trial scheduled for 17CF054 and 17CF099 originally scheduled for Monday is continued. Pre-trial on everything other than 17CF129 scheduled for preliminary hearing date of August 1st.

 

17CF121 - Alissa F. Long - Possession of Meth Less Than 5 Grams, Possession of Syringe or Needle, and Obstruction of Justice / Destroying Evidence. Appearance with Counsel. State has made an offer, but counsel has not had a chance to talk to defense about the offer. Third count read to defendant. Get next court date.

 

17CF022 - Justin L. Marlow - Domestic Battery with a Prior - Appearance with Counsel. Also 17CM017 - Criminal Trespassing to State Land. Preliminary hearing is waived. Evidence provided by Pana Community Hospital given to state for distribution. Formal arraignment is waived, not guilty plea is entered. August trial date scheduled with pre-trial scheduled for July 28th at 10 a.m.

 

17CF069 - David K. Matthews - Aggravated Meth Manufacturing Between 15 and 100 Grams and Possession of Meth Between 5 and 15 grams - Pre-trial. Jury trial is scheduled for next week. Motion of disclosure will be requested by defense. Because of this, both parties are not ready for trial. Trial is continued until August 14th. Next pre-trial scheduled for July 28th at 10 a.m.

 

16CF200 - Bradley D. Merritt - Meth Manufacturing Between 100 and 400 Grams - Pre-trial. Negotiated Plea is reached. Will plead guilty to Meth Manufacturing Between 15 and 100 Grams count. Original Count would be dismissed. He would serve 9 years in prison followed by 3 years of mandatory supervised release.

 

17CF051 - Charles T. Lee - Meth Delivery Between 15 and 100 grams and Aggravated Meth Delivery Between 15 and 100 grams - Pre-trial. Trial scheduled for Monday. Defense requests a continuance on the trial. Trial rescheduled for September. Next pre-trial scheduled for August 24th at 10 a.m.
